A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN FOR FAIRWAY ESTATES, TRACT 4097, BEING A
PORTION OF SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH
MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 1,
1996, a public hearing was conducted to determine whether approval should be granted for an Extension of
Time to Glen L. Ludwig, P.E., of Ludwig Engineering, San Bernardino, California, for the above described
Preliminary Subdivision Plan for Fairway Estates, Tract 4097, and
WHEREAS, the owner/developer of this tract is Glen L. and Pearle A. Ludwig, San Bernardino,
California. The engineer of record is Richard 1. Rieker, P.E., also of Ludwig Engineering, and
WHEREAS, the subdivision is located south of Bullhead 'city and east of Highway 95, at the
southwest comer of Joy Lane and Mountain View Road. The Preliminary Plan depicts approximately 65
acres subdivided into 278 single-family lots, and a parcel for commercial or multi-family use, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on February 5, 1990, per BaS Resolution No. 90-35. The first Extension of Time was granted
on February 3, 1992, per BaS Resolution No. 93-32. The second Extension of Time was granted on
October 4,1993, per BaS Resolution No. 93-275. The third Extension of Time was granted on April 4,
1994, per BaS Resolution No. 94-94. The fourth Extension of Time was granted on March 10, 1995, per
BaS Resolution No, 95-83. Subdivision Regulation Article 3.10-1 states: "Upon application to the
Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be
granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action
is not taken then all proceedings relating to the plat shall be terminated", and
WHEREAS, the developer of the project has indicated in a letter dated January 16, 1996, that an
Extension of Time is being requested based on the following: "The depressed economic conditions in
California since 1990 have severely impacted our rate of sales. With the improving economy, the sales rate
should show considerable improvement both to the benefit of the County and me. Review of your recently
adopted Policies for Extension of Time, the stated purpose for the policy really isn't applicable to Fairway
Estates. The project has been continuously active since 1990 and is a planned unit single family housing
development. It is not a lot sales project, and consequently the market absorption rate is more sensitive to
the market demands for housing, ability of a buyer to qualify for financing, and general economic
conditions", and

WHEREAS, the developer has actively pursued the completion of this project. Tract 4097-A was
recorded on December 18, 1990, and amended on August 28, 1991. Tract 4097-B was recorded on August
28, 1991, and
WHEREAS, this will be the fifth Extension of Time, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action complies with the Mohave County General Plan, and the property is
designated as an Urban Development Area.
c. The site is adequate for the action intended and the proposal is consistent with the
surrounding land uses.
d. This request for an extension complies with the Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 13, 1996, the Commission recommended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following:
I. Compliance with all conditions of BaS Resolution No. 90-35.
2. This Extension of Time will be in effect until February 5,1997.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, March 17, 1996, and posted on March 15, 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 1, 1996, APPROVED this Extension of Time as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
