INDEXED MICROALMED 9634557 BK 2751 PG 8H OFFICIAL RECORDS OF MOHAVE COUNTY, JOAN MC CALL, MOHAVE COUNTY RECORDE' 06/2./96 01:36P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECOROING FEE 0.00 RESOLUTION NO. 96-105 A RESOLUTION SETTING FORTH THE ACCEPTANCE OF AS-BUILT IMPROVEMENT PLANS FOR WILLOW VALLEY ESTATES, UNIT 20, TRACT 4134-A, BEING A PORTION OF SECTION 21, TOWNSmp 18 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on June 17, 1996, a public hearing was conducted to determine whether approval should be granted for the Acceptance of As-Built Improvement Plans for the above described property as requested by McKellips Land Corporation of Phoenix, Arizona, and WHEREAS, the property is located west of State Highway 95 and north of King Street. Access is provided to this parcel from King Street via Kingsley Street or Marina Boulevard, and WHEREAS, the Preliminary Plan for this project was approved by the Board of Supervisors on March 9, 1992, per BaS Resolution No. 92-67. The rezoning of this parcel was approved by the Board of Supervisors on April 6, 1992, per BaS Resolution No, 92-104. The Final Plat for this phase of the project was approved by the Board of Supervisors on AprilS, 1993, per BaS Resolution No. 93-59. A Petition of Exception for Tract 4134 was approved by the Board of Supervisors on August 7, 1995, per BaS Resolution No. 95-225. The first Extension of Time for the approved Preliminary Plan was approved by the Board of Supervisors on February 6, 1995, per BaS Resolution No, 95-33. The second Extension of Time was approved by the Board of Supervisors on May 1, 1995, per BaS Resolution No. 95-208, the approval of which expires March 9, 1996, and WHEREAS, the County Engineer has reviewed the engineer's report and improvements and recommends that the County accept the As-Built Plans, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 13, 1996, the Commission recommended APPROVAL of the As-Built Improvement Plans for Willow Valley Estates, Unit 20, Tract 4134-A, as recommended by the Mohave County Public Works Department, and WHEREAS, a reservoir tank on Parcel C was to provide the fire flow required by BaS Resolution No. 92-67 and ADEQ storage requirements, and WHEREAS, the reservoir tank on Parcel C was denied a Zoning Use Permit by the Board of Supervisors as recommended by the Planning and Zoning Commission, and . RESOLUTION NO. 96-105 Page 2 .... . . ~ ,. , WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 5,1996, and posted on May 3,1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors at their special meeting on Monday, June 17, 1996, APPROVED the As-Built Improvement Plans for Willow Valley Estates, Unit 20, Tract 4134-A, as recommended by the Mohave County Planning and Zoning Commission and outlined herein, subject to the following condition: 1. Assurances, in a form acceptable to Mohave County, shall be posted. The amount shall be equal to the engineer's cost estimates as approved by the County Engineer. The purpose of the assurances is to ensure the completion of the following conditions: a, That the reservoir tank be removed or relocated and a tank be constructed at an acceptable site upon approval of a Zoning Use Permit. b. The current "clapper valve" system on the pumps be replaced with a silent check valve system. c. Enclose pumps and chemical system within a suitable structure. d. Vibration absorbers be added to pipe supports to control vibration. e. Enclose generator and exhaust system within a suitable structure. f. Any fencing remaining after the removal of the tank shall comply with the Mohave County Zoning Regulations. g. All of these conditions shall be met no later than 180 days after the approval of this resolution.
