IN THE NEV. OF SECTION 17. TOWNSHIP 23 NORTH, RANGE 16 WEST, FOR A MOTORCYCLE TRACK IN AN A-R/9A (AGRICULTURAL-RESIDENTIAU NINE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 7, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Joe B. Weber and Kenneth D. Ward of Kingman, Arizona, and WHEREAS, this property is located north of Kingman and east of Stockton Hill Road, approximately ten miles north of Northern Avenue. The site is accessed from Stockton Hill Road via east on Calle Muerlos to the site. The property is located on the southeast comer of Calle Muerlos and A venida Del Burro. The property is flat and has been graded for a motorcycle motorcross track and is sloping slightly to the east. The surrounding land uses consist of vacant rangeland. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant requests this Zoning Use Permit for a motorcycle track. This is an allowable use per Mohave County Zoning Regulations, Section 27.A-3, Special Uses. The Mohave County General Plan designates this area as a Suburban Development Area, The Long Mountain Area Plan designates this as RR-5A (Rural Residential/Five Acre Minimum) area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2000B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, there are no residences in the area now, but there are concerns about the long-term effect, including the noise and the diminution of property values, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan, but does not comply with the Long Mountain Area Plan. c, The site is adequate for the action intended and the use is consistent with the surrounding terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. RESOLUTION NO. 96-95 Page 2 . .... ,~'" .... . . PAGE 2 OF 2 BK 2699 PG 68 FEE~9612927 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 14, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is intended for a motorcycle track and activities related there10. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 3. The applicants will provide a four-foot (4'0") field fence around their property to keep the participants off the surrounding property. 4. The applicants will provide adequate dust control for the race track before each event to keep the dust to a minimum. 5. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 6. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 7. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 18, 1996, and posted February 21, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Thursday, March 7,1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
