A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 95-422
WHICH APPROVED A REZONE OF THE SOUTHEASTERLY FWB :rEl'S: ACRES OF PARCEL
13, CEDAR HILLS RANCHES, IN SECTION 29, TOWNSHIP 21 NORTH, RANGE 14 WEST,
FROM C-2H110A (GENERAL COMMERCIAL HIGHWAY FRONT AGErrEN ACRE MINIMUM
LOT SIZE) TO C-2H15A (GENERAL COMMERCIAL HIGHWAY FRONTAGEIFIVE ACRE
MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 7,
1996, a public hearing was conducted to determine whether approval should be granted for an Amendment
to BaS Resolution No. 95-422 which approved a Rezone of the above described property as requested by
Nellie Blake of Kingman, Arizona, and
WHEREAS, due to an administrative error the Rezone Resolution only rezoned the southerly five
acres of Parcel 13 and it should have rezoned the southerly ten acres of Parcel 13, and
WHEREAS, the language to be deleted is ~ and the language to be added is Q.ouble und~lined,
and
WHEREAS, this property is located north of Interstate 40 and west of the Blake Ranch Road
interchange. The site is accessed from Interstate 40 via north on Blake Ranch Road to Kathy Road, then
west on Kathy Road to the site. The site is on the southwestern comer of Kathy Road and Ty Road. The
, ..
property is vacant and slopes slightly toward the west. The surroundin!joland uses consist of vacant land to
the north, west and Interstate 40 to the south. There is a truck stop with associated buildings to the east.
There are no significant drainage patterns crossing the property, and
WHEREAS, the applicant proposes this zone change to allow a truck lubrication station. The
Mohave County General Plan designates this area as a Rural Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2375B indicates the parcel described to be
in Zone A, in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect on the property complies with the Mohave County
General Plan.

c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site, excent the noted EJ::MA
Snecial flood Ha7"rd Area.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 14, 1996, the Commission recommended APPROVAL of the proposed Amendment to BOS
Resolution No. 95-422 which approved a Rezone of Parcel 13, CEDAR HILLS RANCHES subject to the
following:
1. This property will be rezoned C-2H/5A (General Commercial Highway Frontage/Five Acre
Minimum Lot Size).
2. The submittal and recordation ofa Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.
3. The Board of Supervisors accepts the dedication of 45-foot radius curves at all dedicated
roadway intersection points.
4. The Board of Supervisors accepts the granting of the eight feet adjacent to all dedicated
roadways for Public Utilities Easements (PUEs).
5. The dedications and grantings required by the Rezone resolution shall be shown on the
Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation.
6. The parcel shall have legal access.
7. The Parcel Plat shall show any surface drainage and FEMA flood zones.
8. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits. The site plan must include a limited drainage report to mitigate any
additional drainage created by this development. Also, paving requirements will be
determined by the Public Works Department upon site plan submittal.
9. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation.
10. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11-829E.

11. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to mee1 the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, February 18, 1996, and posted February 21, 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Thursday, March 7, 1996, APPROVED this Amendment to BaS Resolution No. 95-422 which approved
a Rezone of Parcel 13, CEDAR HILLS RANCHES, as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
