RESOLUTION NO. 96-92
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A SPECIFIC USE PERMIT
ON A PORTION OF PARCEL 5, FORT ROCK RANCHES, UNIT I-B, IN SECTIONS 7 AND 8,
TOWNSHIP 20 NORTH, RANGE 11 WEST, FOR THE ESTABLISHMENT OF A WATER
BOTTLING FACILITY IN A M (GENERAL MANUFACTURING) ZONE, IN THE MOHAVE
COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 7,
1996, a public hearing was conducted to determine whether an Extension of Time for a Specific Use Permit
should be granted for the above described property as requested by Jeffrey Coombs, President, Aquarius
Water Company of Lake Havasu City, Arizona, and
WHEREAS, this property is located south ofInterstate 40, approximately 30 miles east of the City
ofK.ingman. The site is accessed from 1-40 via the Knight Creek Interchange, then south along an unnamed
road to Knight Creek Road, then east to the site, The property is part of a 40-acre parcel containing a home
and a dirt landing strip; the three-acre parcel reserved for the bottling facility is vacant. The surrounding
land uses consist of mostly vacant land and a few scattered homes. There are no significant drainage
patterns crossing the property. The Mohave County General Plan designates this area as a Rural
Development Area, and
WHEREAS, this Specific Use Permit was conditionally approved by the Mohave County Board of
Supervisors on October 4,1994, per BaS Resolution No. 94-354, and
WHEREAS, the applicant requested in a letter dated December 11, 1995, that the Specific Use
Permit be extended for one year, and
WHEREAS, this will be the first Extension of Time for this property. The approved Extension of
Time Policy allows two Extensions of Time when a developer is actively pursuing a schedule of completion,
and
WHEREAS, a review of FEMA FIRM Panel #040058-2425B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended.

d. The site has legal access.
e. There are no significant environmental features affecting the site.
f. This action does comply with the approved Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 14, 1996, the Commission recommended APPROVAL for an Extension of Time for a Specific Use
Permit subject to the following:
1. Continued compliance with the conditions of BaS Resolution No. 94-354.
2. This Extension of Time will be in effect until October 4,1996.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, February 18, 1996, and posted February 21, 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Thursday, March 7, 1996, APPROVED this Extension of Time for a Specific Use Permit as
recommended by the Mohave County Planning and Zoning Commission and outlined herein.
