A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF THE N'h

(GENERAL MANUFACTURlNGIFIFTEEN ACRE MINIMUM LOT SIZE) ZONE, IN THE
MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 7,
1996, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be
granted for the above described property as requested by the owner, Janet Daniell of Bullhead City, Arizona,
and
WHEREAS, this property is located two miles northeast of the Bullhead City limits and north of
Highway 68. The site is accessed from Highway 68 via northwesterly on Katherine Mine Road, an
undocumented roadway, approximately one-half mile from Highway 68. The Rezone application is for
liquid waste recycling ponds for septic and sewage sludge. The property is vacant and the surrounding land
uses consist ofa single family residence to the south, with the remainder of the area vacant. There is BLM
land to the north and east, State land to the west and private land to the south. The topography of the area
has a variety of washes which have channelled through the terrain, creating small steep hills that cross the
property. The Mohave County General Plan designates this area as an Urban Development Area, and
WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors
on March 1, 1994, via BaS Resolution No, 94-70. It was extended for the first time with BaS Resolution
No. 95-37 on January 11, 1995, On January 3, 1995, the Board of Supervisors approved the Specific Use
Permit via BaS Resolution No. 95-10, and
WHEREAS, this Extension of Time will allow the applicant to complete the final stages of
permitting with ADEQ. At this time they have received the soil samples for the aquifer permit and are only
6 months away from construction. Also, this will allow the applicant time to complete the other conditions
as required by BaS Resolution Nos. 94-70 and 95-37, and
WHEREAS, this will be the second Extension of Time for this property. The approved Extension
of Time Policy allows two Extensions of Time when a developer is actively pursuing a schedule of
completion, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2280C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and

WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
f. This action does comply with the approved Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 14, 1996, the Commission recommended APPROVAL for an Extension of Time for a Rezone
subject to the following:
1. Continued compliance with the conditions of BaS Resolution No. 94-70.
2. This Extension of Time will be in effect until March 1, 1997.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, February 18, 1996, and posted February 21, 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Thursday, March 7, 1996, APPROVED this Extension of Time for a Rezone as recommended by the
Mohave County Planning and Zoning Commission and outlined herein.
