A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF THE E'h
SWv. OF SECTION 23, TOWNSIDP 19 NORTH, RANGE 22 WEST, FOR A WELL SITE FOR
BERMUDA WATER COMPANY, INC., IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE,
IN THE SOUTH MOHA VE V ALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 7,
1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above described property as requested by Bermuda Water Company, Inc., of Bullhead City, Arizona and
Dennis Gootrad, Gootrad Engineering, Inc., of Westlake Village, California, being represented by G. Kelly
Grier, Stovall Engineers, Inc., of Bullhead City, Arizona, and
WHEREAS, this property is located south of Bullhead City, east of Highway 95 and north ofEI
Rodeo Road. The site is accessed from Highway 95 via east on El Rodeo Road to the site. The property
is located on the north side ofEI Rodeo Road approximately one-quarter mile east of Highway 95. The
property is vacant, flat and slopes slightly to the west toward the Colorado River. The surrounding land uses
consist of residences to the east and south, and several commercial businesses to the southwest. There is
a mobile home park to the west and vacant property to the north. There are no significant drainage patterns
that cross the property, and
WHEREAS, the applicant requests this Zoning Use Permit to allow a water well site for Bermuda
Water Company, Inc., a public utility company. The Mohave County General Plan designates this area as
an Urban Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2445C indicates the parcel described to be
in Zone AO, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site, except for the noted
Special Flood Hazard Area,

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 14, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
I. This Zoning Use Permit is intended for a water well site for Bermuda Water Company, Inc.,
a public utility company, and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits.
3. A revised Preliminary Plan for Rodeo Park, Tract 4145, will be submitted to reflect the
adjustment ofthe affected lots.
4. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.
5. The applicant will construct a wall that is compatible with the material and height of the
fence around Arrowhead Park Mobile Home Park.
6. The appropriate zoning, building, environmental and floodplain permits will be obtained.
7. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
8. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety and welfare.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, February 18, 1996, and posted February 21, 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Thursday, March 7,1996, APPROVED this Zoning Use Permit as recommended by the Mohave County
