A RESOLUTION SETTING FORTH A SPECIFIC USE PERMIT ON A PORTION OF THE NWV.
SWv. OF SECTION 36, TOWNSHIP 16 NORTH, RANGE 21 WEST, FOR OPERATING A
NATURAL GAS PROCESSING PLANT IN A M-X (IlEA VY MANUFACTURING) ZONE, IN THE
SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 7,
1996, a public hearing was conducted to determine whether a Specific Use Permit should be granted for the
above described property as requested by Mohave Pipeline Operating Company, a subsidiary ofEI Paso
Natural Gas Company, on behalf of EI Paso Fuel Development Company, also a subsidiary of EI Paso
Natural Gas Company, of Bakersfield, California, being represented by the Mohave County Economic
Development Authority, Inc., of Kingman, Arizona, and
WHEREAS, this property is located north of Interstate 40 between the Topock Interchange and
Needle Mountain Interchange. The site is accessed from Interstate 40 via north at the Needle Mountain
Interchange to a paved access road along the EI Paso Pipeline road/pipeline right-of-way across State of
Arizona land to the site. The property is vacant and the terrain is gently rolling hills that slope slightly to
the southwest toward the Colorado River. The surrounding land uses consist of vacant State of Arizona land
to the north, east and south. The Havasu National Wildlife Area is to the west. There is an EI Paso Natural
Gas Company facility to the southwest and the Mohave Pipeline Operating Company Compressor Station
to the west. There are no significant drainage patterns that cross the property, and
WHEREAS, the applicant requests this Specific Use Permit to allow for the construction and
operation of a natural gas processing facility. The applicant proposes to use a 34.53-acre portion of the
NWY, SW'/. of Section 36. The Mohave County General Plan designates this area as a Rural Development
Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2815C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a, All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 14, 1996, the Commission recommended APPROVAL for a Specific Use Permit subject to the
following:
1. This Specific Use Permit is intended for constructing and operating a natural gas processing
facility and activities related thereto; any new use will require another Specific Use Permit.
2. The Specific Use Permit will commence upon the effective date of the rezone for this
property.
3. The gas processing facility will be operated under the guidelines of the National Fire
Protection Association and the Arizona State Fire Marshal Office.
4. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits. The dike around the storage tanks will be designed large enough to
be able to contain the contents of all four tanks in case of catastrophic failure of the tanks.
5 The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction.
6. Approval of a Specific Use Permit with such conditions and restrictions as the Board of
Supervisors may impose, shall be valid for two (2) years, in which time construction on the
project shall commence or the use authorized shall be initiated. Prior to expiration of the
approval, the developer may request an Extension of Time from the Commission to initiate
the project, and the Commission shall recommend to the Board'an action based upon a
finding of substantial grounds of which to grant such an Extension of Time up to one (1)
year.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, February 18, 1996, and posted February 21, 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
