OF SECTION 22, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM C-2H18A (GENERAL COMMERCIAL HIGHWAY FRONTAGEIEIGHT ACRE MINIMUM LOT SIZE) ZONE TO C/SD (COMMERCIAL/SPECIAL DEVELOPMENT) ZONE, IN THE SOUTH MOHA VE V ALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 7, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Safeway, Inc., Tempe, Arizona, being represented by Mary E. Smith, Safeway Real Estate Director, and WHEREAS, this property is located south of Bullhead City and west of Highway 95 between Aztec Road and El Rodeo Road. The site is accessed directly from Highway 95 to the west. This project will also provide access to Aztec Road, The property is vacant and slopes slightly to the west toward the Colorado River. The surrounding land uses consist of other highway business on the east side of Highway 95 and vacant property on the north, west and south sides. There are no significant drainage patterns that cross the property, except for the EI Rodeo Drainage Channel that runs along the southern side of this property, and WHEREAS, the applicant requests this zone change to 11.95 acres to develop a commercial shopping area on the site. The plan includes a number of retail spaces in connection with a large grocer marketplace and separate pads for a bank, gas station and a fast food restaurant. The C2H/8A (General Commercial Highway Frontage/Eight Acre Minimum Lot Size) zoning does not allow the selling of any lot smaller than eight acres. A rezone to C2H would allow lots with 10,000 square feet to be sold; however, the applicant proposes pads from 5,200 to 3,500 square feet in size. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone AO, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. The site has legal access. f. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 14, 1996, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned C/SD (Commercial/Special Development). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B ofthe Standard Specifications and Details is required. 3. The applicant will provide a CC&Rs (Covenants, Conditions and Restrictions), or similar, type of agreement that specifies joint use or availability to access points, parking areas, maintenance requirements, common use area, landscape and lighting. 4. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. Also, Aztec Road must be improved to County Collector standards to the west access of the parking lot. The parking lot will be paved to County Specification 171 or equivalent. 5. The appropriate zoning, building, environmental and floodplain permits will be obtained. 6. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 7. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 18, 1996, and posted February 21, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. RESOLUTION NO. 96-82 Page 3 ,. . , . . NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Thursday, March 7, 1996, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
