WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 7, 1996, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above described property as requested by the owners J. P. and Mary Gerami of Garden Grove, California, and WHEREAS, the property is located south of Bullhead City on the southeast corner of Harbor Avenue and Vacation Drive. The site is accessed from Harbor Avenue. The property is still vacant and there have not been any improvements completed in connection with the establishment of a commercial business. There are no significant drainage patterns that cross the property. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, this zone change was conditionally approved by the Mohave County Board of Supervisors on January 7,1991, per BOS Resolution No. 91-8. On June 1, 1992, the Mohave County Board of Supervisors approved BaS Resolution No. 92-183 for an Extension of Time. A second Extension of Time was granted per BaS Resolution No. 93-276 on October 4, 1993, BaS Resolution No. 94-100 was approved granting a third Extension of Time on April 4, 1994. A fourth Extension of Time was granted via BaS Resolution No. 95-36 on February 6,1995, and WHEREAS, the applicant requested in a letter dated November II, 1994, that the rezoning be extended for one year. The letter states, "We are still waiting for sewer to become available in order to meet the remaining conditions," and WHEREAS, this Extension of Time will allow the applicant to meet the conditions as required by BaS Resolution Nos. 91-8, 92-183 and 93-276. BaS Resolution Nos. 92-183 and 93-276 added conditions to the original BaS Resolution No. 91-8. A site survey has established that there have not been any changes to this property from the previous Extension of Time request, and WHEREAS, this will be the fifth Extension of Time for this property. The approved Extension of Time Policy allows only two Extensions of Time when a developer is actively pursuing a schedule of completion, and -. - . . . RESOLUTION NO. 96-80 Page 2 PAGE 2 OF 2 BK 2699 PG 38 FEE~9612913 WHEREAS, a review ofFEMA FIRM Panel #040058-2615C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. g. This action does not comply with the approved Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 14, 1996, the Commission recommended DENIAL for an Extension of Time for a Rezone based upon the following: I. It appears that this developer has not accomplished any of the conditions of the previous four . resolutions and has used the "waiting for sewer" reason for each extension. 2. The approved Extension of Time Policy allows only two Extensions of Time when a developer is actively pursuing a schedule of completion. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 18, 1996, and posted February 21, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Thursday, March 7, 1996, DENIED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
