RESOLUTION NO. 96-79
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED
PRELIMINARY PLAN FOR THE HIGHLANDS, TRACT 4091, BEING A SUBDIVISION OF A
PORTION OF THE W'h OF SECTION 7, TOWNSHIP 18 NORTH, RANGE 21 WEST, IN THE
SOUTH MOHA VE V ALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 7,
1996, a public hearing was conducted to determine whether approval should be granted for an Extension of
Time for the above described property to The Hollingsworth Joint Venture consisting of Dempsey
Construction Corporation, Mammoth Lakes, California, and HOLPAL, a California Ltd. Partnership,
Pasaden~ California. The engineer of record for this subdivision is William E. Miller of Holland West,
Incorporated, Bullhead City, Arizona, and
WHEREAS, the subdivision is located one mile east of Highway 95 and is bounded by Boundary
Cone Road to the north, Jerome Road on the south, Girard A venue to the east and Vanderslice Road on the
west. Primary access is from Highway 95, then east on Boundary Cone Road. The submitted preliminary
plan depicts 320 acres subdivided into 770 lots. The minimum lot size will be 7,500 square feet, with a
maximum lot size of 10,000 square feet, providing a density of2.5 units per acre, and
WHEREAS, water to the subdivision will be provided by the Mohave Valley Water Company,
electric and telephone service by Citizens Utilities, sewer by the Fort Mojave Tribal Utilities Authority, and
solid waste disposal by Tri-State Disposal. The subdivision will be served by the Mohave Valley Fire
Department, and
WHEREAS, the applicant's reasons for the Extension of Time are as follows:
I. "Both Dempsey and HOLPAL have expended tremendous time and money in connection
with this development, with every intention to having it be a positive addition to the housing
supply of Mohave County."
2. "Unfortunately, as a result of the severe economic downturn and the general real estate
malaise in Mohave Valley the development was not able to go forward to the point of sales
to the general public,"
3. "It is believed the negative real estate climate may be reversing itself and the extension of
the Preliminary Plan approval for Tract 4091 is requested to permit the development to take
place on the same terms and conditions as previously submitted and approved," and

WHEREAS, it should be noted that the sale of Tract 4091-A, a portion of the Preliminary Plan in
Final Plat processing, is contingent upon the granting of this Extension of Time, and
WHEREAS, the revised preliminary plan for this tract was approved by the Mohave County Board
of Supervisors on April 2, 1990, via BaS Resolution No. 90-77. The Final Plat for a portion of this
subdivision was approved on November 5, 1990, via BaS Resolution No. 90-329. The first Extension of
Time was granted on June I, 1992, via BaS Resolution No. 92-181. The second Extension of Time was
granted on May 3, 1993, via BaS Resolution No. 93-116. Extensions of Time were not applied for in 1994
or 1995. The present Extension of Time action will bring up to date those Extensions of Time not applied
for in 1994 or 1995 as well as grant the current Extension of Time, and
WHEREAS, this will be the third, fourth and fifth Extensions of Time, and
WHEREAS, Article 3.10-1 of the Mohave County Subdivision and Road Maintenance Regulations
states: "Upon application to the commission and prior to the expiration of the time limit, extensions in
increments of one (I) year may be granted by the board if the subdivider is actively processing the final plat.
If such action is not taken then all proceedings relating to the plat shall be terminated," and
WHEREAS, the following are Findings of Fact for the above captioned item:
a, All notices have been advertised and posted according to regulations.
b. The proposed action complies with the Mohave County General Plan, and the property is
located in an Urban Development Area.
c, The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. Phase One ofthe Preliminary Plan, Tract 4091-A, has proceeded to Final Plat.
e. Extensions of Time were not applied for in 1994 or 1995.
f. This request for an extension does not comply with the Extension of Time Policy, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 14, 1996, the Commission recommended APPROVAL for an Extension of Time subject to the
following:
1. Compliance with all conditions as stated in BaS Resolution No. 90-77.
2. A newly signed commitment from Bermuda Water Company for water service to each lot.
3. A newly signed commitment from Fort Mojave Tribal Utilities Authority to provide sewer
service to each lot.
4, This Extension of Time will be in effect until April 2, 1997.

WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, February 18, 1996 and posted on February 21,
1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Thursday, March 7, 1996, APPROVED this Extension of Time as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
