A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED
PRELIMINARY PLAN FOR MESA VISTA, TRACT 4117, BEING A PORTION OF THE W'h SWv.
OF SECTION 24, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE
VALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 7,
1996, a public hearing was conducted to determine whether approval should be granted for an Extension of
Time for the above described property to the Rossberg Family Trust, Los Angeles, California. The engineer
of record for this subdivision is William E. Miller of Holland West, Incorporated, Bullhead City, Arizona,
and
WHEREAS, the subdivision is located one mile east of Highway 95 and is bounded by Mountain
View Road to the west, Camp Mohave Road to the north and EI Rodeo Road to the south. The primary
access to the subdivision is from Highway 95, then east on EI Rodeo Road. The Preliminary Plan depicts
approximately 42 acres subdivided into 147 lots and one 4-acre commercial lot. With a 6,000 square foot
minimum single-family residential lot size, the maximum density will be 3.5 lots per acre, and
WHEREAS, according to the developer, water will be supplied by Bermuda Water Company,
electric power by Mohave Electric Cooperative, and telephone service by Citizens Utilities Company.
Sewage disposal is proposed by package treatment plant or hook-up to Sorenson Utility Company, Inc. Fort
Mojave Mesa Fire Department \vill be providing fire protection for this project. A private carrier will be
collecting and transporting solid waste to the Mohave Valley Landfill, and
WHEREAS, in a letter dated December 28, 1995, Mr. Brenner Holland, Holland West, Inc., relates
that the "recording ofthe final plat and the construction of the project were not previously pursued because
of the downturn in the local housing market and the restructuring of the property ownership and partners."
It should be noted that this property has changed ownership at least ten different times since Black Mountain
Development, the original subdivider, began the subdivision process in 1989, and
WHEREAS, Mr. Holland continues by stating that "the new owner, The Rossberg Family Trust,
Robert C. Rossberg, Trustee, now wishes to develop the project and has authorized Holland West, Inc., to
complete the items needed to record the Final Plat and begin construction. For several months, Holland
West has been revising and updating the construction plans and Final Plat, meeting with utility companies,
reinstating previous approvals, bidding the project to local contractors, etc...," and

WHEREAS, the developer has submitted a final plat and capital improvement plans for the County's
review and comment. Mr. Holland concludes by saying that the "owner is prepared to post assurances for
the infrastructure improvements and we expect, with County assistance, to record the Final Plat in the first
few months of 1996," and
WHEREAS, the Preliminary Subdivision Plan was approved on December 3, 1990, via BaS
Resolution No. 90-349. BaS Resolution No. 91-110, dated April 1, 1991, approved the Final Plat which
has not been recorded. BaS Resolution No. 94-39, from February I, 1994, granted the first and second
Extensions of Time. BaS Resolution No. 95-3 granted the third Extension of Time on January 3,1995, and
WHEREAS, Article 3.10-1 of the Mohave County Subdivision and Road Maintenance Regulations
states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in
increments of one (1) year may be granted by the Board if the subdivider is actively processing the Final
Plat. If such action is not taken then all proceedings relating to the plat shall be terminated," and
WHEREAS, this will be the fourth Extension of Time, and
WHEREAS, following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action complies with the Mohave County General Plan, and the property is
located in an Urban Development Area.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The developer has submitted evidence which satisfies BaS Resolution No. 95-3.
e. This request for an extension does not comply with the Extension of Time Policy, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 14, 1996, the Commission recommended APPROVAL for an Extension of Time subject to the
following:
1. Compliance with all conditions as stated in BaS Resolution Nos. 90-349 and 91-110.
2. Compliance with requirements of the letter dated January 22, 1996 from the Mohave County
Planning and Zoning Department, which includes comments from Public Works and
Environmental Health. See Exhibit "A" attached.
3, The determination by the Mohave County Flood Control District that this development, as
proposed, will have no adverse impact upon the channel and the request to FEMA to remove
areas south of the channel from the floodplain.

4. Prior to any activity within the EI Rodeo Road Channel, the developer must obtain approval
from and abide by any conditions imposed by the Mohave County Flood Control District.
5. This Extension of Time will be in effect until December 3,1996.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, February 18,1996 and posted on February 21,
1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Thursday, March 7,1996, APPROVED this Extension of Time as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.

Dear Mr. Holland:
The Environmental Health, Public Works and Planning and Zoning Departments have compiled the
comments for the above referenced project as follows:
Environmental Health Dept:
1. Our Division has no objection to the continued processing of the above projectJparcel. The
proposed subdivision v.-ill have public sewer and water service (see comments from Public
Works and Planning on this issue). Please note that appropriate approvals for water and
sewer service must be obtained from ADEQ,
Public Works:
Final Plat Comments:
Due to the scope of the proposed work v.-ithin and around the El Rodeo Road Drainage Channel and
Mohave County Flood Control District's efforts to remove certain areas South of the Channel from
the Floodplain, we asked the Extension of Time for this development be conditioned upon the review
and approval, by FEMA, of the projects proposed drainage related improvements. We are in the
process of submitting all drainage and improvement information to Arizona Department of Water
Resources in order to start the review.
In addition, we offer the following comments:
1. The Final Plat needs to depict the FEMA AO Zone depth break lines as noted on FIRM

2. It appears that several lots on the final plat have finished floor elevations which do not mect
the FEMA AO Zone requirements when compared to the preliminary plan topo and will need
to be revised accordingly.
3. Matching ROW for Mountain View Road will need to be obtained prior to Final Plat
Recordation. Record references for these instruments will need to be added to the Final Plat.
4. The instrument references for those portions of the El Rodeo Channel, to be granted by
Mohave County, needs to be added to the plat.
5. The Dedication Statement needs to include Parcel B as a dedication, not as a granting,
6, The section lines, along the West and South boundaries of this development need to be
labeled as such.
7. The finished floor elevation oflot 21 block 2 appears to be incorrectly listed as 6743,7 and
needs to be corrected.
8. Our records indicate that the East boundary of Parcel A is 92.27 feet, not 94.27 feet as shown
on the plat and should be corrected.
9. Two proposed monument comers located on the North El Rodeo Road right-of-way line at
the West 1116th line and at the PC of the curve need to be labeled as subdivision comers.
10. The alley requirement may be addressed with the submittal of a site plan once the use is
established.
11. An updated set of Covenants, Conditions and Restrictions will need to be submitted.
12. !fit is the intent of the developer to phase this subdivision,:1 Phasing Plan will need to be
submitted for review.
13. A tie needs to be shown on the final plat to the West ]/4 corner of this section along with a
description of the 1/4 corner.
14. The words "and maintained" need to be removed from the Parcel B pur,)ose statement.
15, The word "way" needs to be replaced with "easement" in the Parcel C purpose statement.
] 6. The description for the SW Comer of this Section is outdated. The current descriptio:1 needs
to be shown on the Final Plat.
17. The location of the found EI Rodeo Road Channel and EI Rodeo Road centerline monument

needs to be added to the final plat. Also, the symbol used for the monument docs not match
the description in the legend.
18. A slope easement will need to be shown on the final plat for lots 1-6, block 1 and for a
portion of Parcel A.
Improvement Plans Comments:
1. The final improvements plans need to be certified to by the Engineer of Record, complete
with seal, signature and date.
2. The improvement plans need to be revised to show 3 inches of asphaltic concrete over 5
inches of aggregate base course material as stipulated in the soils report.
3. Street and stop signs will need to be placed on separate U channel poles as per Standard
Specification, Detail 20 and 21. P]ea~e find enclosed the revised Mohave County Standard
Details for Street and Stop Signs No. 20 and No. 21.
4. A mix design for the asphaltic concrete will need to be submitted for review.
5. The provider of sewer disposal needs to be added to page 1 of the improvement plans.
6. Full width improvements will need to be shown for Mountain View Road. These
improvements will need to be reflected in the cost estimate.
Gradinl$ Permit Request:
1. It is our opinion that, at this time, we can only consider the issuance of a grading permit for
the interior subdivision overlot and street grading for that portion of the subdivision north
of the EI Rodeo Road Channel right-of-way.
2. Grading quantities will need to be listed on the grading plans to allow determination of
grading permit application requirements. All proposed grading in excess of 5000 CU YD
is considered Engineered Grading and will need to comply with Chapter 70 of the Uniform
Building Code, Many of the requirements of the UBC Chapter 70 have been meet by the
submittal requirements ofthe subdivision regulations, however, I am including a copy of the
Engineered Grading Permit Checklist for the engineer's use. Please be aware that bonds will
need to be posted for any grading work performed prior to the posting of subdivision
assurances.

General Comments:
1. A water allotment statement from M.V.I.D.D. and water adequacy statement from A.D.W.R,
will need to submitted prior to plat recordation,
2. Approvals from A.D.E.Q. for the water supply and distribution system and the proposed
sewer disposal system will need to be submitted for review.
3. The developer needs to provide utility service contracts from all of the affected utility
companies. If any off-site improvements are necessary these costs will need to be reflected
in the Engineer's Cost Estimate.
4. A current title report needs to be submitted.
Planning and Zoning Dept:
1. When submitting the revised Final Plat please include these items per Article 3.10-5 of the
Mohave County Subdivision and Road Maintenance regulations as follows:
a. Five copies of the Final Plat.
b, Two copies of the preliminary Title Report or poliey of title insurance issued by a
title insurance company within the preceding 30 working days. .. First American's
report includes several deficiencies which must be remedied prior to the Plat's
presentation to the BaS. Please submit a new title report showing that all
deficiencies have addressed First American's requirements for issuing litle insurance,
c. An updated copy of the C.C.& Rs. with new notary stamp and signature to be
recorded, Please also include articles of incorporation and the bylaws establishing
the homeowner's association which will enforce the C.C.&Rs.
d. Two sets of revised construction plans per Public Works comments.
e. A fee for recording the Final Plat.
f. Assurance for completion and maintenance of improvements. . .
g. A copy of the developer's report to the Arizona Real Estate Commission. The copy
submitted is not complete. Those conditions set bY the resolution approving the
Final Plat must be covered in the report.
h, Five copies of a memo showing the total area of the subdivision, and showing the
area of each lot in square feet. This must have the current Engineer of Record sta.'11p,
2. We require written proof from the Moha\'e Valley Irrigation and Drainage District
(MVI&DD) and Arizona Department of Water Resources (ADWR) that there is a cure-em
available water supply for this project.
_'. The westerly portion of Mountain View Road, beyond the Tract's boundaries. must mention
when and by whom it will be "granted by in a separatc docu:nent."

4. Property taxes for the second half of 1995 are due on parcel 223-07-001.
5. Please update the vicinity map to show Bullhead City's present corporate boundary.
6. Please provide a copy of the Warranty Deed and Deed of Trust, as required by First
American, for our review.
7. This Sorenson sewer main is approximately one mile from this project. According to
Sorenson, the sewer line will be constructed when Mesa Vista. Tract 41 ] 7 is approved.
Please see Public Works comments regarding the need for construction plans and a cost
estimate for this sewer line.
8. If a phasing plan is adopted, please submit ten sets of a revised preliminary plan showing the
phasing lines, clearly identifying all required infrastructural improvements per phase and
their sequencing. Please see Public Works for further detail.
