SWv. OF SECTION 33, TOWNSHIP 41 NORTH, RANGE IS WEST, FOR A RESIDENCE IN A C-2 (GENERAL COMMERCIAL) ZONE, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 7, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Anthony and Rena Moerman of Littlefield, Arizona, and WHEREAS, this property is located north of the Interstate 15/Littlefield Interchange approximately one mile north on the west side of US Highway 91. The site is accessed directly from US Highway 91. The property is relatively flat with a mobile home, a nursery, gift shop and pet store on it. The surrounding land uses consist of two recreational vehicle parks on the south and west sides. There is a mobile home park and a retail plant nursery on the north side. The Arizona Department of Transportation (ADOT) maintenance yard is across Highway 91 on the east side. There are no significant drainage patterns that cross the property, and WHEREAS, the applicant requests this Zoning Use Permit to allow a residential home on this commercial property. The Mohave County General Plan designates this area as a Rural Development Area and an outlying community, and WHEREAS, a review ofFEMA FIRM Panel #040058-0026B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a, All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain, d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access, f. There are no significant environmental features affecting the site. g, This is to correct a zoning violation; the home is in place on the property. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 14, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is intended for a residential home in a C-2 (General Commercial) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. All uses are existing; any additional use will require Section 27.P (Site Plan Requirements) to be completed and approved prior to approval of permits. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 4. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 18, 1996, and posted February 21, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Thursday, March 7,1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
