A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE EY> NW'I. NE'I. OF LAKE
HA V ASU ACRES TWO, IN SECTION 29, TOWNSHIP IS NORTH, RANGE 19 WEST, FOR A
CELLULAR TELEPHONE COMMUNICATIONS SITE IN AN A-R/36A (AGRICULTURAL-
RESIDENTIALffHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, IN THE LAKE HAVASU
CITY AREA, MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 7,
1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above described property as requested by Mohave Cellular Limited Partnership, dba Citizens Mohave
Cellular Company, being represented by Bruce A. Mitchell, P .E., Right-of- Way Supervisor for the Citizens
Utilities Company of Kingman, Arizona, and
WHEREAS, this property is located east of Highway 95 and south ofHavasu Heights Boulevard
and is northeast of Lake Havasu City. The site is accessed from Highway 95-via east on Havasu Heights
Boulevard, then south on Rice Drive to Sierra Vista Road, then south on Sierra Vista Road to Sky-View
Drive, then south on Sky-View Drive to the Bureau of Land Management (BLM) land in Section 18, then
continuing south on an undocumented trail/road through BLM land to the site. The site is located
approximately 2.2 miles south and slightly east of the intersection of Sky-View Drive and Coronado Road.
The property is vacant and has gently rolling hills. The surrounding land uses consist of vacant BLM land
to the north and the Lake Havasu Acres Two subdivision to the south, east and west. There are no
significant drainage patterns that cross the property, and
WHEREAS, the applicant requests this Zoning Use Permit to allow a cellular telephone
communications site with a 70-foot self-supporting tower and a 12-foot by 20-foot building. The Mohave
County General Plan designates this area as a Rural Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-3000B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the cellular telephone site is in operation. It was approved via BOS Resolution No.
92-346 on November 2, 1992. The legal description for this resolution reads that the W'h of the NW\4 of
the NE\4 of Section 29 has the cellular site on it where, in fact. the site is on the E'h ofthe NW\4 of the NE\4
of Section 29, This was an error made by Citizens Utilities when they applied for the Zoning Use Permit
for this site, and

WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 14, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
I. This Zoning Use Permit is intended for a cellular telephone communications site with a 70-
foot self-supporting tower and a 12-foot by 20-foot building and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
3. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety and welfare.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, February 18, 1996, and posted February 21, 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Thursday, March 7, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
