SE'I. SE'I. SE'I. OF SECTION 16, TOWNSHIP 39 NORTH, RANGE 16 WEST, FOR A SECONDARY RESIDENCE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 7, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Carl Preston of Mesquite, Nevada, and WHEREAS, this property is located south ofInterstate 15 and north of Elbow Canyon Road. The site is accessed from Mesquite, Nevada via east on Elbow Canyon Road to the site. The property is located on the north side of Elbow Canyon Road approximately one and one-half miles east of the ArizonalNevada state line and is accessed directly from Elbow Canyon Road. The property has two residences, two barns and a garage, and is relatively flat. The surrounding land uses consist of other residences and vacant range/farm land. There are no significant drainage patterns that cross the property, and WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A-R (Agricultural-Residential) zone for a non-commercial guest house. The Mohave County General Plan designates this area as a Rural Development Area and an outlying community, and WHEREAS, a review ofFEMA FIRM Panel #040058-0200B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b, The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended. d. The site has legal access. e. There are no significant environmental features affecting the site. f. This is to correct a zoning violation; the second residence is in place on this property. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 14, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 96-76 PAGE 2 OF 2 BY. 2699 F'G 28 Page 2 FEH9612909 . . "" . . 1. This Zoning Use Permit is for a mobile home as a secondary residence on this property and the activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.R (Accessory or Secondary Residence Requirements) and a site plan in accordance with Section 27.R must be completed and approved prior to approval of permits. 3. The Board of Supervisors accepts the dedication of the 42 feet along the south boundary of this property as roadway right-of-way for Elbow Canyon Road. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 18, 1996, and posted February 21, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Thursday, March 7, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein, MORAVE COUNTY BOARD OF SUPERVISORS
