RESOLUTION NO. 96-62
A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF SECTION 14 AND
SECTION 23, TOWNSHIP 22 NORTH, RANGE 16 WEST, LYING NORTH AND WEST OF U.S.
HIGHWAY 66, FROM A-R/I0A (AGRICUL TURAL-RESIDENTIALrrEN ACRE MINIMUM LOT
SIZE) ZONE TO M-X (HEAVY MANUFACTURING) ZONE, IN THE KINGMAN AREA,
MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February
5, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the
above described property as requested by Leonard Edward Hafley ofK.ingman, Arizona, and
WHEREAS, this property is located north of the Kingman Airport and northwest of Highway 66
approximately one mile northeast of the entrance to the airport. The site is accessed from Highway 66. The
property is vacant and the terrain is sloping slightly toward the southwest. The surrounding land uses consist
of vacant land, the Kingman City Sewage Disposal to the west, and a few scattered residences and highway
businesses along State Highway 66 to the northwest. There are several significant washes crossing this
property, including the Mohave Wash along the northwest comer of Section 14 and Frees Wash running
from the northwest to the southeast of Section 14, and
WHEREAS, the applicant requests this zone change to allow a landfill on this property. The
Mohave County General Plan designates this area as a Suburban Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2170B indicates a portion of the parcel
described to be in Zone AH, Zone AO and Zone B, in the Special Flood Hazard Area, and a portion in Zone
C. not in the FEMA Special Flood Hazard Area. and
WHEREAS, the Mohave County Public Works Department requests concurrence from the Arizona
Department of Transportation (ADOT)for the method of accessing State Highway 66. Also, the developer
should investigate the applicability ofthe Army Corps of Engineers' 401 and 404 permits for environmental
and flood impacts, and
WHEREAS, Citizens Utilities Company, Telephone and Electric Division, notes that Citizens
Utilities has a buried telephone cable paralleling State Route 66 approximately 500 feet off the roadway
right-of-way running through Sections 14 and 23. Blue Stake will have to be called at 1-800-STAKE IT
before construction of any kind is done, and

WHEREAS, the following described Findings of Fact are for the above captioned item:

a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect may comply with the Mohave County General Plan.
c. The site is adequate for the action intended but the use is not consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are significant environmental features affecting the site including the noted Special
Flood Hazard Zone.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
January 10, 1996, the Commission recommended DENIAL for a Rezone based upon the following:
1. There are significant environmental features affecting the site including the noted Special
Flood Hazard Zone and the two major washes that cross the property.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, January 21, 1996, and posted January 19, 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, February 5, 1996, DENIED this Rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
