A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 90, GATEWAY ACRES,
TRACT 9, IN SECTION 17, TOWNSffiP 2S NORTH, RANGE 19 WEST, FOR GARBAGE
COMPANY TRUCK PARKING, REPAIRS AND OFFICE SPACE IN AN A (GENERAL) ZONE,
IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February
5, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above described property as requested by Joe Comstock of Kingman, Arizona, and
WHEREAS, this property is located east of Highway 93 and north of Pierce Ferry Road. The site
is accessed from Pierce Ferry Road via east on Fifth Street to Caballaro Drive, then north on Caballaro Drive
to the site. The property is located on the west side of Caballaro Drive between Fifth Street and Sixth Street.
The property is vacant and flat, sloping slightly to the southwest. The surrounding land uses consist of
vacant land and a few scattered residences. There are no significant drainage patterns that cross the property,
and
WHEREAS, the applicant proposes this Zoning Use Permit to allow parking for garbage company
trucks, repairs and office space. The Mohave County General Plan designates this area as a Rural
Development Area and an outlying community, and
WHEREAS, a review ofFEMA FIRM Panel #040058-1775B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
January 10, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:

1. This Zoning Use Permit is intended for garbage company truck parking, repairs and office
space and activities related thereto.

2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits.
3. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety and welfare.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, January 21, 1996, and posted January 19. 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, February 5, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
