RESOLUTION NO. 96-54 A RESOLUTION SETTING FORTH A REZONE OF A LARGE PORTION OF SECTION 12 AND THE SYZ OF SECTION 13 EXCEPT FOR THE EAST 50 FEET AND THE SYZ NWY. OF SECTION 13, TOWNSHIP 19 NORTH, RANGE 18 WEST, FROM A-R/36A (AGRICULTURAL- RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO M-X (HEAVY MANUFACTURING) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 5, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by the First Interstate Bank of Arizona, N.A. as Trustee for the Dorothy Helmich Barker Trust, being represented by E. R. Bruce of Kingman, Arizona, and WHEREAS, this property is located south of Kingman and west of Interstate 40 at the Griffith Interchange. The site is accessed from Interstate 40 via west on Griffith Road to Apache Road, Both sites are accessed from Apache Road; Section 12 is located approximately one-half mile north of Griffith Road and Section 13 is located approximately one-eighth mile south of Griffith Road. The property is vacant and relatively flat, with the terrain sloping slightly to the southwest. The surrounding land uses consist of vacant rangeland, the proposed Citizens Utilities Company power generation plant to the west in the north half of Section 14, and the Praxair plant to the east. There are no significant drainage patterns that cross the property, and WHEREAS, the applicant requests this zone change to allow for Industrial Development. The applicant proposes to develop approximately 629 acres in Section 12 except for four 1 \I.-acre parcels owned by the City of Kingman, and approximately 397 acres in the south half and the Sy, of the NW\I. of Section 13. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2500B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b, The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. . . PAGE 2 OF 2 BK 26B4 PG 584 FEE~9606841 RESOLUTION NO. 96-54 Page 2 d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 10, 1996, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned M-X (Heavy Manufacturing). 2. A Specific Use Permit is required before this property can be developed. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Upon development. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 5. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS ll-829E. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 21,1996, and posted January 19, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 5,1996, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
