RESOLUTION NO. 96-51 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A SPECIFIC USE PERMIT ON A PORTION OF THE NY, SWv. NWV. OF SECTION 19, TOWNSHIP 21 NORTH, RANGE 20 WEST, FOR THE ESTABLISHMENT OF LIQUID WASTE RECYCLING PONDS IN A M (MANUFACTURING) ZONE IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 5, 1996, a public hearing was conducted to determine whether an Extension of Time for a Specific Use Permit should be granted for the above described property as requested by Harry and Janet Daniell, Daniell's Septic Service, Bullhead City, Arizona, and WHEREAS, this property is located approximately two miles northeast of Bullhead City and north of Highway 68. The site is accessed from Highway 68 via Katherine Mine Road, which is an undocumented roadway. The purpose of the application is for liquid waste recycling ponds for septic and sewer sludge. The property is vacant and the surrounding land uses to the proposed site consist of a single family residence to the south, with the remainder ofthe area vacant. There is BLM land to the north and east, State land to the west and private land to the south, The topography of the area has a variety of washes which have channelled through the terrain, creating small steep hills that cross the property. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, this Specific Use Permit was conditionally approved by the Mohave County Board of Supervisors on January 3, 1995, per BOS Resolution No. 95-10, and WHEREAS, the applicant requested in a letter dated November 6, 1995, that the Specific Use Permit be extended for one year. The letter stated that "We are in the final stage of the permitting in ADEQ. At this time we are awaiting soil samples for the aquifer permit. We hope that we are only 6 months away from construction but this has been moving very slowly in ADEQ," and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-2280C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan, . PAGE. OF t BK 2684 PG 582 FEE~9606840 RESOLUTION NO. 96-51 Page 2 c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. f. The request complies with the Mohave County Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 10, 1996, the Commission recommended APPROVAL for an Extension of Time for a Specific Use Permit subject to the following: 1. Continued compliance with the conditions ofBOS Resolution No. 95-10. 2. This Extension of Time will be in effect until January 3,1997. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 21,1996, and posted January 19, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 5, 1996, APPROVED this Extension of Time for a Specific Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
