SWv. OF SECTION 14, TOWNSHIP 21 NORTH, RANGE 19 WEST, FROM A-R/I0A (AGRICULTURAL- RESIDENTIALffEN ACRE MINIMUM LOT SIZE) ZONE TO R-l/35M, A-R/6A, AND A-R120A (SINGLE FAMILY RESIDENTIAL/35,OOO SQUARE FOOT MINIMUM LOT SIZE, AGRICULTURAL-RESIDENTIAL/SIX ACRE AND TWENTY ACRE MINIMUM LOT SIZE) ZONES, IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 5, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by the owners. Alfonso and Rosemarie Zinni of Scottsdale, Arizona, and WHEREAS, the property is accessed from Highway 68 via south on Estrella Road to the site at the northwest corner of Collins Drive and Estrella Road, The property has one mobile home on it. The terrain is flat. The adjacent land uses consist of similar residential uses with mobile homes on the properties. There are small washes that cross the property, and WHEREAS, the applicant proposes to divide the 40-acre parcel into three parcels of 35,000 square feet, one 6-acre parcel, and one 26-plus-acre parcel. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, water is provided along Estrella Road by Golden Valley Improvement District, and WHEREAS, a review ofFEMA FIRM Panel #040058-2326B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. A comment by Flood Plain was to not develop in the flow path of the wash indicated on the FIRM map, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan, c. The site is adequate for the action intended. d. The neighboring area contains other like land uses similar to the above proposed action. e, The site has legal access. f. There are no significant environmental features affecting the site. .. . . PAGE 2 OF 3 BK 2684 PG 573 FEEt9606838 RESOLUTION NO. 96-49 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 10, 1996, the Commission recommended APPROVAL for a Rezone subject to the following: I. The three northwestern parcels will be rezoned R-J/35M (Single Family Residential/35,000 Square Foot Minimum Lot Size), the southwestern parcel to A-R/6A (Agricultural- Residential/Six Acre Minimum Lot Size), and the eastern parcel to A-R/20A (Agricultural- Residentialffwenty Acre Minimum Lot Size), 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. The Board of Supervisors accepts the dedication to the public of the 50-foot easement known as Estrella Road as road right-of-way. Thirty-five feet of the existing easement known as Abrigo Drive, and 30 feet of the existing easements known as Collins Drive and Carrizo Road will be dedicated to the public as road rights-of-way with the remainder of the 50-foot easements being granted as Public Utility Easements (PUEs) and Drainage Easements (DEs). In addition, 20-foot radius curves are required at all dedicated roadway intersection points. 4. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 5. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 6. Each parcel shall have legal access. 7. The Parcel Plat shall show any surface drainage and FEMA flood zones. 8, The appropriate zoning, building, enviromnental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 9. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification. as per ARS 11-829E. 10. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. RESOLUTION NO. 96-49 Page 3 . . PAGE 3 OF 3 BK 2684 PG 574 FEEI9606838 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 21, 1996, and posted January 19, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 5,1996, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
