OF LOT 34, MOHA VE MESA ACRES, TRACT 1020, IN SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST, FOR A SECONDARY RESIDENCE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 5, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Samuel G. and SueAnne Babcock of Bullhead City, Arizona, and WHEREAS, this property is located east of Highway 95 and south of Joy Lane. The site is accessed from Highway 95 via east on Joy Lane to Mission Road, then south on Mission Road to the site. The property is located on the east side of Mission Road between Chaparral Road and Pinion Road. The terrain is relatively flat. The lot has a residence on it and the surrounding land uses consist of vacant property and other residences. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A-R (Agricultural-Residential) zone for a family member to live in. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a, All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site except the noted Special Flood Hazard Area, WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 10, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: . . . . PAGE 2 OF 2 BK 268~ PG 560 FEE~960683J RESOLUTION NO. 96-43 Page 2 I. This Zoning Use Permit is for a mobile home as a secondary residence on this property and the activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.R (Accessory or Secondary Residence Requirements), and a site plan in accordance with Section 27.R must be completed and approved prior to approval of pennits. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall tenninate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 21,1996, and posted January 19, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 5, 1996, APPROVED this Zoning Use Pennit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
