WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 3, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Rick G. Harrison of Mount Carmel, Illinois, and WHEREAS, this property is located south of Bullhead City and east of Highway 95 on Boundary Cone Road. The site is accessed from Highway 95 via east on Boundary Cone Road to the site. The property is located on the north side of Boundary Cone Road approximately three and one-half miles from Highway 95 between Bradley Drive and Chauncey Boulevard. The property is vacant and the terrain is sloping slightly to the west. The surrounding land uses consist of vacant land, a recreational park to the east and a welding shop to the southwest. There is one significant drainage pattern crossing the property running east to west, and WHEREAS, the applicant requests this zone change to allow a welding shop, a residence and a recreational vehicle park. The applicant proposes to rezone the 150 feet adjacent to Boundary Cone Road to CoMO (Commercial-Manufacturing/Open Lot Storage) for the welding shop. The remainder of the property will remain A-R (Agricultural-Residential). This allows a residence outright but the recreational vehicle park will require a Zoning Use Permit. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, this item was first heard at the Planning and Zoning Commission meeting on January 10, 1996, and was approved by a unanimous vote. At their February 5, 1996 meeting, the Board of Supervisors referred this item to the Planning and Zoning Commission for further review after receiving several letters of protest from surrounding property owners. The applicant changed his request of rezoning the entire parcel to only rezoning the front 150 feet along Boundary Cone Road, and . . . All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 8, 1996, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The 150 feet (approximately 1.03 acres) adjacent to Boundary Cone Road will be rezoned to C-MO (Commercial-Manufacturing/Open Lot Storage) for the welding shop. The remainder of the property will remain A-R (Agricultural-Residential). 2. A-R zoning allows a residence but requires a Zoning Use Permit for a recreational vehicle park. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. Section 27,P shall include a screening fence and landscaping as a buffer for business. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction, 5, The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 6. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension. determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832, WHEREAS, the notice of hearing was published in the Kingman Daily Miner. a newspaper of general circulation in Kingman, Mohave County, Arizona, May 19, 1996, and posted May 17, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. PAGE 3 OF 3 BK 2744 PG 593 FEE~9631714 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 3, 1996, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
