A RESOLUTION SETTING FORTH AN EXTZNSION OF TIME FOR A ZONING USE PERMIT ON A PORTION OF SECTION 16, TOWNSHIP 14 NORTH, RANGE 20 WEST, FOR THE ESTABLISHMENT OF A MOBILE HOME PARK IN A R-E (RESIDENTIAL-RECREATION) ZONE, IN THE LAKE HA V ASU CITY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 5, 1996, a public hearing was conducted to determine whether an Extension of Time for a Zoning Use Permit should be granted for the above described property as requested by Havasu Heights Ranch & Development Corporation of Fort Wayne, Indiana, and WHEREAS, the property is located at the northeast comer of London Bridge Road and Chenoweth Drive. The site is accessed from Highway 95 west on Chenoweth Drive to the site. The site is located on the northeast comer of Chenoweth Drive and London Bridge Road. The proposed expansion is in two parts located on either side of the existing mobile home park; the property is vacant. The surrounding land uses consist of vacant land to the north, east and west, a mini-storage to the south and a fire station to the southwest. There are no significant drainage patterns crossing the property. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the proposal is to develop this property for a mobile home park with the spaces for rent ONL Y, and WHEREAS, this Zoning Use Permit was conditionally approved by the Mohave County Board of Supervisors on December 7, 1992, via BOS Resolution No, 92-381. It was extended for the first time with BOS Resolution No. 94-36 on February 1. 1994, A second Extension of Time was granted on August 7, 1995. via BOS Resolution No. 95-220. and WHEREAS, while considering the last Extension of Time, the Planning and Zoning Commission and the Board of Supervisors received numerous complaints about the existing park. Those complaints included an inadequate water system. deteriorated roads and excessive storage of junk. Environmental Health and the Arizona Department of Environmental Quality investigated the existing park and issued correction notices. According to Larry \Vebert of the Environmental Health office in Lake Havasu City, most of the concerns have been corrected. An on-call operator is needed for the water system; this appears to be the most serious outstanding matter, and , " .. ..- -" RESOLUTION NO. 96-38 Page 2 WHEREAS, the applicant requested in a letter dated November 13, 1995, that the Zoning Use Permit be extended for one year, The letter stated that "Additional time is required for various reasons; including: I) Uncertainties were caused by the 8 month delay in processing the previous request for extension of time. 2) There were generally weak economic conditions in Lake Havasu City and a lack of demand for spaces is anticipated within the year. Very few mobile home spaces exist in the Lake Havasu City area. 3) The Corporation plans to proceed with development during the next 12 months," and WHEREAS, this will be the third Extension of Time for this property, and WHEREAS, a review ofFEMA FIRM Panel #040058-3] lOB indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 10, 1996, the Commission recommended APPROVAL for an Extension of Time for a Zoning Use Permit subject to the following: I, Continued compliance with the conditions ofBOS Resolution No. 92-381, ~ This Extension of Time will be in effect until December 7,1996. 'WHERE <\S, the notice of hearing was published in the Kingman Daily Miner. a newspaper of general circulation in Kingman, Mohave County, Arizona, January 21, ] 996, and posted January 19, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, NO"" THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 5, 1996, DENIED this Extension of Time for a Zoning Use Permit based upon the following: , .. ..
