RESOLUTION NO. 96-168
A RESOLUTION SETTING FORTH A REZONE OF LOT 22, SUNHA VEN HOMESITES, IN
SECTION 33, TOWNSHIP 22 NORTH, RANGE 16 WEST, FROM C-2/1A (GENERAL
COMMERCIAL/ONE ACRE MINIMUM LOT SIZE) ZONE TO R-E/IA (RESIDENTIAL-
RECREATION/ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE KINGMAN AREA, MOHA VE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 6,
1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above
described property as requested by Pearl A. Bates, the ov.ner, and Connie Black, her granddaughter, of
Kingrnan, Arizona, and
WHEREAS, this property is located northwest of Highway 66 between Diagonal Way and
Sunhaven Lane. The site is accessed from Highway 66 via northwest on Diagonal Way to Able Drive, then
northeast on Able Drive to the property, located on the southeast side approximately 500 feet northeast of
Diagonal Way. The property is flat and contains a single family residence and a garage. The surrounding
land uses consist of other single family residences, vacant property and several commercial businesses
fronting on Highway 66. There are no significant drainage patterns that cross the property, and
WHEREAS, the applicant requests this zone change to allow the placement of a second mobile
home on this property so that her granddaughter can be the applicant's care giver. The Mohave County
General Plan designates this area as an Urban Development Area, and
WHEREAS, all the lots on the southeast side of Able Drive are zoned C-2/1A, except for four that
are zoned R-lIIA. Board of Supervisors Resolution No. 90-146, dated July 2,1990, approved the Zoning
Use Permit for the mobile home, All have single family residences except for three small businesses. All
the remaining lots on the northwest side of Able Drive in Sunhaven Homesites are zoned R-lIIA, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2165C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.

d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
April I 0, 1996, the Commission recommended APPROVAL for a Rezone subject to the following:
1. This property will be rezoned R-E/IA (Residential-Recreation/One Acre Minimum Lot
Size).
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
3. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction,
4. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11-829E.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, April 21, 1996, and posted April 19, 1996, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 6, 1996, APPROVED this Rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
