MOHAVE COUNTY RECOROEf 05/13/96 02:05P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-166 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 205, LAKE MOHA VE RANCHOS DEVELOPMENT UNIT 3, IN SECTION 1, TOWNSHIP 25 NORTH, RANGE 19 WEST, FOR A SECONDARY RESIDENCE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 6, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Frankie and Peggy M. Hamilton, Jr. of Dolan Springs, Arizona, and WHEREAS, this property is located east of Dolan Springs, southeast of Pierce Ferry Road. The site is accessed from Pierce Ferry Road via east on Eleventh Street to Ironwood Drive, then south on Ironwood Drive to the property, located on the west side ofIronwood Drive approximately 500 feet north of Tenth Street. The property has two mobile homes, an old church chapel building and a workshop on it. The property is relatively flat, sloping slightly to the west. The surrounding land uses consist of vacant lots and other single family residences. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A-R (Agricultural-Residential) zone. The Mohave County General Plan designates this area as a Rural Development Area and an outlying community, and WHEREAS, a review ofFEMA FIRM Panel #04005S-ISOOC indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the Mohave County Public Works Department notes that access to this property is substandard, consisting of a 30-foot roadway easement, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. .,. _..- ... . . RESOLUTION NO. 96-166 PAGE 2 OF 2 BK 2730 PG 992 FEE~9626013 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 10, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. This Zoning Use Permit is for a mobile home as a secondary residence on this property and the activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.R (Accessory or Secondary Residence Requirements) and a site plan in accordance with Section 27.R must be completed and approved prior to approval of permits. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained within 90 days of approval. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 21, 1996, and posted April 19, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 6,1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
