MOHAVE COUNTY RECORDEr 05/13/96 02:04P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-163 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A ZONING USE PERMIT ON A PORTION OF THE RICE BIRD PATENTED MINING CLAIM IN THE SAN FRANCISCO MINING DISTRICT, IN SECTION 23, TOWNSHIP 19 NORTH, RANGE 20 WEST, FOR A MOBILE HOME IN A C-l (NEIGHBORHOOD COMMERCIAL) ZONE, IN THE OATMAN PORTION OF THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 6, 1996, a public hearing was conducted to determine whether an Extension of Time for a Zoning Use Permit should be granted for the above described property as requested by Ellen DeLong of Oatman, Arizona, and WHEREAS, this property is located within the Oatman Townsite on the west side of Highway 66 and is accessed from Highway 66. The property is hilly and has a house being used as an art gallery on it. There are no significant drainage patterns crossing the property. The Mohave County General Plan designates this area as a Rural Development Area and an outlying community, and WHEREAS, this Zoning Use Permit was conditionally approved by the Mohave County Board of Supervisors on March 10,1995 with BOS Resolution No. 95-103, and WHEREAS, the applicant requested in a letter dated February 16, 1996, that the Zoning Use Permit be extended for one year, and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review ofFEMA FIRM Panel #040058-2475B indicates the parcel described to be in Zone D, in a FEMA Unmapped Area. Recommendation: Do not build within the possible flood boundaries of any wash, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d, The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. g. This request for an Extension of Time complies with the approved Extension of Time Policy. ~.. _.~ . . PAGE 2 OF 2 BK 2730 PG 983 FEE~9626010 RESOLUTION NO. 96-163 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 10, 1996, the Commission recommended APPROVAL for an Extension of Time for a Zoning Use Permit subject to the following: 1. Continued compliance with the conditions ofBOS Resolution No. 95-103. 2. This Extension of Time will be in effect until March 10, 1997. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 21, 1996, and posted April 19, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 6,1996, APPROVED this Extension of Time for a Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
