RESOLUTION NO. 96-161
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE SOUTHERLY 400 FEET
OF THE E2/3 EYz OF PARCEL 4, IN SECTION 12, TOWNSHIP 21 NORTH, RANGE 19 WEST,
FOR A RESIDENCE IN A C-2H (GENERAL COMMERCIAL HIGHWAY FRONT AGE) ZONE,
IN THE GOLDEN V ALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 6,
1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above described property as requested by Stephen M. Hitchinson of Golden Valley, Arizona, and
WHEREAS, this property is located on the north side of Highway 68 between Teddy Roosevelt
Road and Milky Way Road. The site is accessed directly from Highway 68. The property has King Tut's
mini-market on it and is relatively flat, sloping slightly to the southeast. The surrounding land uses consist
of vacant property and several other highway businesses. There are no significant drainage patterns crossing
the property, and
WHEREAS, the applicant requests this Zoning Use Permit to allow a residence in a commercial
zone; the applicant plans on using a large travel trailer. Mohave County Zoning Regulations, Section 21.1,
Regulations for C-2H (General Commercial Highway Frontage) zoning, does not allow travel trailers to be
used as residences. The Mohave County General Plan designates this area as an Urban Development Area,
and
WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect does not comply with the Mohave County General Plan.
c. The request does not comply with Mohave County Zoning Regulations.
d. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
April I 0, 1996, the Commission recommended DENIAL for a Zoning Use Permit based upon the following:

I. Mohave County Zoning Regulations, Section 21.1, Regulations for C-2H (General
Commercial Highway Frontage) zoning, does not allow travel trailers to be used as
residences.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, April 21, 1996, and posted April 19, 1996, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 6, 1996, DENIED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
