OF PARCEL 242, IN THE NW'I. SE'I. OF SECTION 6, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R/I0A (AGRICULTURAL-RESIDENTIALITEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN V ALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 6, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Jay A. and Marilyn A. Jemison of Golden Valley, Arizona, and WHEREAS, this property is located north of Highway 68 between Colorado Road and Teddy Roosevelt Road. The site is accessed from Highway 68 via north on Colorado Road to Chino Drive, then west on Chino Drive to Ligurta Road, then north on Ligurta Road to the property, located on the northeast corner of Earl Drive and Ligurta Road. The property is vacant and flat, sloping slightly to the southeast. The surrounding land uses consist of vacant lots and several single-family residences. There are no significant drainage patterns that cross the property, and WHEREAS, the applicant requests this zone change to build a house on this property. This rezone is required because the property was divided by Record of Survey and is exactly ten acres, When the easements are subtracted from the gross acreage, the net is less than the ten-acre minimum lot size for this zoning. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2150B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e, The site has legal access. f. There are no significant environmental features affecting the site. , , ~ . . . PAGE 2 OF 2 BK 2730 PG 960 FEE~9625999 RESOLUTION NO. 96-153 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April I 0, 1996, the Commission recommended APPROVAL for a Rezone subject to the following: I. This property will be rezoned A-R/5A (Agricultural-Residential/Five Acre Minimum Lot Size). 2. The Board of Supervisors accepts the dedication of 3 5 feet of the roadway easement known as Ligurta Road and 30 feet of the roadway easement known as Earl Drive as road rights-of- way, complete with 20-foot radius curves at their intersection. The remaining portion of the original 50-foot easements for Ligurta Road and Earl Drive will be granted to the public as Public Utilities Easement and Drainage Easements (PUE & DEs). 3. The dedications and grantings required by the Rezone resolution shall be accomplished by separate instrument and the dedications shall be accepted by the Board of Supervisors. 4. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 5. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 6. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 7. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 21, 1996, and posted April 19, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
