A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 4, BLOCK G, DESERT
LAKES ESTATES, TRACT 4152-A, IN SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST,
FOR A MODEL HOME SALES OFFICE IN A R-O (SINGLE F AMIL Y RESIDENTIAL/MOBILE
HOMES PROHIBITED) ZONE, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 6,
1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above described property as requested by Elmhurst Development Corporation, Inc., being represented by
Kurt Zimmerman, President, of Fort Mohave, Arizona, and
WHEREAS, this property is located east of Highway 95 and south of Bullhead City. The site is
accessed from Highway 95 via east on Joy Lane to Mountain View Road, then south on Mountain View
Road to Desert Greens Lane, then east on Desert Greens Lane to Sandtrap Way, then south on Sandtrap Way
to the property, located on the northeast corner of Sandtrap Way and Sandwedge Lane. The property
contains a single-family residence that is under construction. The surrounding land uses consist of vacant
lots and five lots with single-family residences, also under construction, The streets have been graded, but
have not been paved. There are no significant drainage patterns crossing the property, and
WHEREAS, the applicant requests this Zoning Use Permit fa allow a model home sales office. The
Mohave County General Plan designates this area as an Urban Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2445A indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations,
b. The proposed action and effect complies with the Mohave County General Plan.
c, The site is adequate for the action intended and the use is consistent with the surrounding
terrain.
d, The site has legal access.
e. There are no significant environmental features affecting the site,

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
April 10, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
I. This Zoning Use Permit is intended for a model home sales office on Lot 4 and activities
related to the selling of homes within the Desert Lakes Estates, Tract 4152-A, subdivision.
No off-site sales will be allowed.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
3. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety and welfare.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, April 21, 1996, and posted April 19, 1996, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 6,1996, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
