RESOLUTION NO. 96-149
A RESOLUTION SETTING FORTH A REZONE OF LOT 19, RIO HACIENDA, TRACT 1224, IN
SECTION 14, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM R-MHI20M (SINGLE FAMILY
RESIDENTIAL MOBILE HOMEITWENTY THOUSAND SQUARE FEET MINIMUM LOT SIZE)
ZONE TO R-MH/15M (SINGLE FAMILY RESIDENTIAL MOBILE HOME/FIFTEEN
THOUSAND SQUARE FEET MINIMUM LOT SIZE) ZONE, IN THE SOUTH MORAVE VALLEY
AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 6,
1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above
described property as requested by Richard S, Barber of Golden Shores, Arizona and Windmill Properties,
Inc. of Bullhead City, Arizona, and
WHEREAS, this property is located east of Highway 95 and south of Bullhead City. The site is
accessed from Highway 95 via east on Camp Mohave Road to the site, located on the north side of Camp
Mohave Road between A venida Chico and Puerto Verde Circle, The east half ofthe property has a double
wide mobile home on it and the west half is vacant. The terrain is relatively flat, sloping slightly to the
southwest. The surrounding land uses consist of single-family residences and vacant lots. There are no
significant drainage patterns crossing the property, and
WHEREAS, the applicant requests this zone change to split Lot 19 and proposes to divide the
35,574 square foot lot into two 17,787 square foot lots. The Mohave County General Plan designates this
area as an Urban Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2435D indicates the parcel described to be
in Zone AO, in the Special Flood Hazard Area, and
WHEREAS, a request to rezone Lot 15 of this subdivision to R-MH/15M was denied by the Board
of Supervisors via BOS Resolution No. 94-217 on July 5, 1994, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended but the use is not consistent with the surrounding
land uses and terrain.

d. The neighboring area does not contain any other like land uses similar to the above proposed
action.
e. The site has legal access.
f. There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
April I 0, 1996, the Commission recommended DENIAL for a Rezone based upon the following:
1. The division would not be consistent with the surrounding lots in the Rio Hacienda, Tract
1224, Subdivision.
2. The Rio Hacienda, Tract 1224, Subdivision has remained as it was originally established by
the subdivider, except for the portion abandoned for the Palm Estates II, Tract 4104,
subdivision. This lot split would be the first lot division allowed and may set a precedence
for additional splits in this subdivision.
3. The division of this parcel would become a spot zone in terms of increased density.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, April 21, 1996, and posted April 19, 1996, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 6, 1996, DENIED this Rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
