RESOLUTION NO. 96-143
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN OF DESERT LAKES GOLF COURSE AND ESTATES,
UNIT F, TRACT 4132, BEING A PORTION OF THE NW'I. OF THE NE'I. OF SECTION 35,
TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE VALLEY AREA,
MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 6,
1996, a public hearing was conducted to determine whether approval should be granted for an Extension of
Time as requested by Sterling Varner, Vice President and Coordinator of Desert Lakes Development, Fort
Mohave, Arizona, for the above described Preliminary Subdivision Plan, and
WHEREAS, the owner/developer of this subdivision is Angelo Rinaldi, Desert Lakes Development,
Fort Mohave, Arizona. The new engineer of record is Ray Stadler, P.E., of Stadler Consulting Engineers,
Phoenix, Arizona, and
WHEREAS, the subdivision is located approximately three miles south of Bullhead City, east of
State Highway 95, at the southwest corner of Joy Lane and Club House Drive. The Preliminary Plan depicts
8.7 acres subdivided into 38 single-family lots and two water well parcels, and
WHEREAS, the developer of the project has indicated in a letter dated February 23, 1996, that an
Extension of Time is being requested based on the following: "The delay in work on this Tract has been
due to a change in Engineers. The new Engineer is Raymond Stadler, P,E. He has been working with the
county on our Preliminary Plat for a Grading Permit (for) Tract #4132. We would appreciate the county's
granting our request for an extension of time on this project.", and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on December 2,1991, per BOS Resolution No. 91-331. The first and second Extensions of
Time were granted on March 10, 1995, per BOS Resolution No, 95-84. Subdivision Regulation Article
3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions
in increments of one (I) year may be granted by the Board of Supervisors if the subdivider is actively
processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be
terminated.", and
WHEREAS, this will be the third Extension of Time, and
WHEREAS, the following are Findings of Fact for the above captioned item:

a. All notices have been advertised and posted according to regulations.
b. The proposed action complies with the Mohave County General Plan, and the property is
designated as an Urban Development Area.
c. The site is adequate for the action intended and the proposal is consistent with the
surrounding land uses.
d. This request for an extension complies with the Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
April I 0, 1996, the Commission recommended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following conditions:
1. Compliance with all conditions ofBOS Resolution Nos. 91-331 and 95-84.
2. This Extension of Time will be in effect until December 2, 1996.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, April 21, 1996, and posted on April 19, 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 6,1996, APPROVED this Extension of Time as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
