RESOLUTION NO. 96-142
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN OF EMERALD RIVER ESTATES, TRACT 4093, BEING
A PORTION OF THE NY, OF THE NW'I. OF SECTION 25, TOWNSHIP 19 NORTH, RANGE 22
WEST, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 6,
1996, a public hearing was conducted to determine whether approval should be granted for an Extension of
Time as requested by Gordon Hanshaw, President of Emerald River Development, Inc., for the above
described Preliminary Subdivision Plan. The engineer ofrecord is Stadler Consulting Engineers, Inc. of
Phoenix, Arizona, and
WHEREAS, the subdivision is located approximately two miles south of Bullhead City, east of
State Highway 95, and south of EI Rodeo Road. The Preliminary Plan depicts approximately 32 acres
subdivided into 107 single-family lots, and
WHEREAS, the original proposal for this subdivision planned for individual septic systems to serve
each lot. Individual septic systems may not be acceptable to the Arizona Department of Environmental
Quality, and
WHEREAS, the developer of the project has indicated in a letter dated February 28, 1996, that an
Extension of Time is being requested based on the following: "We are currently talking with Stephen
Valihora who is President of Sun Valley Airport and is also interested in the possibility of connecting to
sewer. On January 2,1996, I appeared before the county commission requesting participation in forming
a sanitation district with Sun Valley Airport to connect to the tribal sewer, the meeting was rescheduled for
May 15, 1996. Tract 4093 is ready to proceed with the exception of sewer or septic. We have made all
necessary improvements, such as gas, electric, water, telephone, cable and paving. All improvements were
made with the understanding ADEQ would approve our map, due to the problems we have been
experiencing with ADEQ sewer seems to be the only viable alternative to septic systems.", and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on March 5,1990, per BOS Resolution No. 90-58, The first Extension of Time was granted
on January 4, 1993, per BOS Resolution No, 93-4, The second and third Extensions of Time were granted
on September 6,1994, per BOS Resolution No, 94-201. The fourth Extension of Time was granted on May
I, 1995, per BOS Resolution No. 95-175. Subdivision Regulation Article 3.10-1 states: "Upon application
to the Commission and prior to the expiration of the time limit, extensions in increments of one (I) year may
be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action
is not taken then all proceedings relating to the plat shall be terminated.", and

WHEREAS, the developer has actively pursued the completion of this project. Tract 4093-A was
recorded on November 21, 1990, and
WHEREAS, this will be the fifth Extension of Time, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action complies with the Mohave County General Plan, and the property is
designated as an Urban Development Area.
c. The site is adequate for the action intended and the proposal is consistent with the
surrounding land uses.
d. This request for an extension complies with the Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
April I 0, 1996, the Commission recommended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following conditions:
I. Compliance with all conditions ofBOS Resolution Nos, 90-58, 93-4, 94-201, and 95-175.
2. If the Arizona Department of Environmental Quality determines that individual septic
systems are not a feasible option for this development, the approval of the Preliminary Plan
will have to be amended to require hook up to a central sewer system for the subdivision.
3. An ADEQ approval of sanitary facilities shall be submitted to Planning and Zoning prior to
recordation of this subdivision, if they determine that individual septic systems are
acceptable for this development.
4, This Extension of Time will be in effect until March 5, 1997,
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, April 21, 1996, and posted on April 19, 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
