MlCRORlMED J fNUtJI.EIf 9625987 BK 2730 PG 933 OFFICIAL RECORDS OF MOHAVE COUNTY. , JOAN MC CALL, MOHAVE COUNTY RECOROEf 05/13/96 01:40P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-141 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN OF LAKERIDGE ESTATES, TRACT 3035, BEING A PORTION OF SECTION 21, TOWNSHIP 14 NORTH, RANGE 20 WEST, IN THE LAKE HA V ASU CITY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 6, 1996, a public hearing was conducted to determine whether approval should be granted for an Extension of Time as requested by agent Steven Palazzola of Lakeridge Estates Home Owners Association, Scottsdale, Arizona, for the above described Preliminary Subdivision Plan, and WHEREAS, the owner/developer of this subdivision is Lyle Matzdorf of Sun State Development, Scottsdale, Arizona. The engineer of record is Hess-Roundtree Inc., Phoenix, Arizona, and WHEREAS, the subdivision is located north and west of Lake Havasu City, and is accessed via State Highway 95, then west along Chenoweth Drive, and WHEREAS, the Preliminary Plan depicts 80 acres subdivided into 231 single-family lots. The fIrst phase ofthis subdivision, Tract 3035-A, was recorded on June 26, 1992, and WHEREAS, the agent for the developer of this project has indicated in a letter dated February 29, 1996, that an Extension of Time is being requested based on the following: "I am writing this letter as a request for a one (I) year extension oftime to keep Phase 3035-B active. Phase 3035-B is considered Phase II of my Lakeridge Estates project and I am planning on recording Phase 3035-B as soon as Phase 3035-A has recorded enough sales.", and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on January 7,1991, per BOS Resolution No. 91-1. The first Extension of Time was granted on March 8, 1993, per BOS Resolution No. 93-53, The second Extension of Time was granted on April 4, 1994, per BOS Resolution No. 94-101. The third Extension of Time was granted on March 10, 1995, per BOS Resolution No. 95-80. Final Plat approval for Tract 3035-A was granted on January 20, 1992, per BOS Resolution No, 92-22. Subdivision Regulation Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (I) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and ~ . . . PAGE 2 OF 2 BK 2730 PG 934 FEE~9625987 RESOLUTION NO. 96-141 Page 2 WHEREAS, this will be the fourth Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave County General Plan, and the property is designated as an Urban Development Area. c. The site is adequate for the action intended and the proposal is consistent with the surrounding land uses. d. This request for an extension complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April I 0, 1996, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: I. Compliance with all conditions ofBOS Resolution Nos. 91-1, 93-53, 94-101, and 95-80. 2. This Extension of Time will be in effect until January 7, 1997. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 21, 1996, and posted on April 19, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 6,1996, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
