WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on May 20, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Willow Valley Water Company, Inc., being represented by 1. John N. Mihlik, President, of Phoenix, Arizona, and WHEREAS, this property is located west of Highway 95 and south of Bullhead City. The site is accessed from Highway 95 via west on King Street to Kingsley Street, then west-northwest on Kingsley Street to the site on the east corner of Kingsley Street and Clearview Drive. The property is flat, sloping slightly to the west toward the Colorado River. The property contains a water well and an aboveground reservoir tank, surrounded by a six-foot chain link fence. The surrounding land uses consist of a few vacant lots. The majority of the lots have single-family residences on them. The Willow Valley Association club house is to the northwest. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant requests this Zoning Use Permit to allow a well site and water tank to meet the increased requirements of the Arizona Department of Environmental Quality and the local fire marshal. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2605C indicates the parcel described to be in Zone B, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended. d. The site has legal access. e. There are no significant environmental features affecting the site , . . RESOLUTION NO. 96-133 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 1 0, 1996, the Commission recommended DENIAL for a Zoning Use Permit based upon the following: 1. The noise, odor and bulk associated with the water tank makes it incompatible with the residential nature of the neighborhood. 2. Due to the opposition from the surrounding property owners. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 5, 1996, and posted May 3, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, May 20, 1996, DENIED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
