WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April!, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Thomas E. and Peggy 1. Brown of Kingman, Arizona, and WHEREAS, this property is located north of Northern Avenue between North Bank Street and North Benton Street north of the City of Kingman. The site is accessed from Stockton Hill Road via east on Northern Avenue to North Bank Street, then north on North Bank Street to Hearne Avenue and the site. The site is located on the northwest corner of North Bank Street and Hearne Avenue. The property contains a mobile home. The surrounding land uses consist of other vacant property and single-family residences. There is one small business on the east side of North Bank Street. There are no significant drainage patterns crossing the property, and WHEREAS, the applicant requests this Zoning Use Permit to allow a residence and plant nursery in a C-I (Neighborhood Commercial) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2165C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access, f. There are no significant environmental features affecting the site. , "" .' . . RESOLUTION NO. 96-130 PAGE 2 OF 2 BK 2711 PG 19 FEE~9617891 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 13, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. This Zoning Use Permit is intended for a residence and plant nursery and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. If this project is proposing to increase the impervious areas of this site, a limited drainage report along with the site plan will be required. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5, This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 17, 1996, and posted March 15, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April I, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
