WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 1 , 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as initiated by the Mohave County Planning and Zoning Department on advice from the Deputy County Attorney to correct an administrative error, and WHEREAS, this property is located west of North Bank Street between Sierra Vista Avenue and Northern Avenue, north of the City of Kingman. The site is accessed from Stockton Hill Road via east on Gordon Drive to North Bank Street, then north on North Bank Street to the site on the west side, approximately 1,400 feet north of Sierra Vista A venue. The property has a mini-storage and open lot storage of motor homes, boats and trailers on it. The terrain is flat, sloping slightly to the southeast. The surrounding land uses consist of State land to the east and other commercial businesses on the other three sides. There are no significant drainage patterns crossing the property, and WHEREAS, this zone change is to correct an administrative error made when the property was rezoned on May 4, 1992 via BOS Resolution No, 92-153, which rezoned this property from C-2II A (General Commercial/One Acre Minimum Lot Size) zone to C-2H/1A (General Commercial Highway Frontage/One Acre Minimum Lot Size) zone. The property should have been rezoned to CoMO (Commercial- Manufacturing/Open Lot Storage), The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2165C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. - . . PAGE 2 OF 2 BK 2711 PG 15 FEE~9617889 ~. RESOLUTION NO. 96-128 Page 2 f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 13, 1996, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned CoMO (Commercial-Manufacturing/Open Lot Storage). 2. The applicant will provide a six-foot (6'-0") high view-obscuring fence ar9und this property. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 4. The applicant shall pave all driveway access and parking in accordance with Mohave County Standard Specification # 171 or better. 5. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 6. The rezone shall not become effective until at least 30 days after fmal approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 7. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832.
