MOHAVE COUNTY RECORDER 04/03/96 02:1SP PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-116 A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NOS. 90-369. 91- 318. 93-35. 94-46 AND 95-5 WHICH APPROVED THE REZONE AND THE EXTENSIONS OF TIME FOR THE REZONE FOR LOT 5, BLOCK J, GOLDEN SAGE RANCHOS, UNIT 56, IN SECTION 7, TOWNSHIP 21 NORTH, RANGE 17 WEST, IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April I, 1996, a public hearing was conducted to determine whether approval should be granted for the Rescission of the Resolutions for the Rezone and the Extensions of Time for the Rezone for the above described property as requested by Frank and Ruby Lopez of Lamont, California, and WHEREAS, this property is located south of Highway 68 between Kayenta Road and Kaba Road, with frontage on Highway 68. The site is accessed from Highway 68. The property is vacant, relatively flat and slopes slightly to the southwest. There are no significant drainage patterns that cross the property, and WHEREAS, this property was conditionally approved for rezone to C-2H by the Mohave County Board of Supervisors on December 3, 1990, via BaS Resolution No. 90-369. It was first extended on December 2,1991, via BaS Resolution No. 91-318. It was extended the second time via BaS Resolution No. 93-35 on February 1, 1993. A third extension of time was granted via BaS Resolution No. 94-46 on February 1, 1994. On January 3,1995 a fourth extension of time was granted via BaS Resolution No. 95-5. A letter had been sent to the owners notifying them that the approval of their rezoning had expired and that an extension of time was required, There was no response to the Planning and Zoning Department's inquiry concerning an extension of time. Another letter was sent informing the property owner that it would be scheduled for rescission. In their letter dated January 1, 1996, the property owner requested that the rezoning be rescinded, The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site has legal access. d. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 13, 1996, the Commission recommended APPROVAL for the rescission of BaS Resolution Nos. 90-369,91-318,93-35,94-46 and 95-5. . . . PAGE 2 OF 2 BK 2710 PG 992 FEE~9617878 RESOLUTION NO. 96-116 Page 2 WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 17, 1996, and posted March 15, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 1, 1996, APPROVED the rescission ofBOS Resolution Nos. 90-369, 91-318, 93-35, 94- 46 and 95-5 as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
