WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 3, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Mildred T. Williamson of Fort Mohave, Arizona, and WHEREAS, this property is located east of Highway 95 between Camp Mohave Road and Aztec Road, south of Bullhead City. The site is accessed from Highway 95 via east on Aztec Road to La Riqueza Road, then north on La Riqueza Road to the site. The site is located approximately 550 feet on the west side of La Riqueza Road. The property is vacant and the terrain is gently rolling. The terrain slopes slightly to the west. The surrounding land uses consist of vacant lots and several residences. There are no significant drainage patterns that cross the property, and WHEREAS, the applicant requests this zone change to erect a building for use by the Fraternal Order of Eagles. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, this item was first heard at the Planning and Zoning Commission meeting on March 13, 1996, and was approved by unanimous vote. At their April I , 1996 meeting, the Board of Supervisors referred this item to the Planning and Zoning Commission for further review after receiving several letters of protest from surrounding property owners, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended. d. The site has legal access. e. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. . , . RESOLUTION NO. 96-114 . PAGE 2 OF 2 BK 27~2 PG 1~5 FEE~9630610 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 8, 1996, the Commission recommended DENIAL for a Rezone based upon the following: 1. This rezone constitutes spot zoning and is not compatible with the surrounding neighborhood. 2. This development would create excessive traffic, thus overtaxing the road network in the area. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 19, 1996, and posted May 17, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 3,1996, DENIED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein. that ATTEST: "'.
