A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN FOR THE COLORADO RIVERFRONT TERRACE,
PHASE II, TRACT 4135, BEING A PORTION OF SECTION 23, TOWNSHIP 17 NORTH, RANGE
22 WEST, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April I,
1996, a public hearing was conducted to determine whether approval should be granted for an Extension of
Time of the approved Preliminary Plan for Colorado Riverfront Terrace, Phase II, Tract 4135. The
owner/developer of this tract is Frank Curcio ofMohave Valley, Arizona. The engineer of record is Mohave
Engineering Associates Inc., Kingman, Arizona, and
WHEREAS, the subdivision is located adjacent to the Colorado River, east of State Highway 95
and south of Riverfront Parkway. The Preliminary Plan depicts approximately four and one-half acres
subdivided into 22 single-family lots, and
WHEREAS, this tract is adjacent to Colorado Riverfront Terrace, Tract 4082. Both phases of
Colorado Riverfront Terrace have the same owner and will use the same entry way. Phase II has a different
tract number, yet is an extension of recorded Phase I, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on July 22, 1991, per BaS Resolution No. 91-194. A revised Preliminary Plan for this tract was
approved by the Mohave County Board of Supervisors on March 9, 1992, per BaS Resolution No. 92-64.
BaS Resolution No, 95-127, approved on April 3, 1995, served as the first and second Extensions of Time,
making the project current up to March 9, 1995, and allowing one year, expiring on March 9, 1996, to record
the tract. Subdivision Regulation Article 3.10-1 states: "Upon application to the Commission and prior to
the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of
Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all
proceedings relating to the plat shall be terminated", and
WHEREAS, the developer of the project has indicated in a letter dated January 31, 1996, that an
Extension of Time is being requested due to the amount of time required to negotiate agreements with
various reviewing agencies, and to arrange funding for the project. The letter explains: "This request has
several items attached which indicate my efforts to proceed to Final as soon as funding has been placed into
my account, which should be mid March, 1996, notably:

I. Will serve letters from all utility companies.
2. Letter from Fort Mojave Indian tribal farms indicating our agreement to remove and relocate
water intake pumps now located along the Colorado River which is necessary to proceed to
Final Plat recording.
3. Letter from my funding source regarding their commitment to fund the projects.
4. Letter from my contractor regarding the work completed to date on the projects.
5. Letter from the Department of the Army, Corp of Engineers which grants an extension of
Permit No. 92-40325-MB for construction of the Coves channel from the Colorado River
into the planned 41 acre marina.
6. Letter from Game and Fish which indicates our partial completion of the Wetland
Restoration Plan."
Additionally, "I have invested over $1.8 million of my own capital to bring the process to this point.
I am definitely proceeding ahead with the Final Plan upon funding....! anticipate actual construction
to begin by early Spring of 1996.", and
WHEREAS, this will be the third Extension of Time, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action complies with the Mohave County General Plan, and the property is
designated as an Urban Development Area.
c. The site is adequate for the action intended and the proposal is consistent with the
surrounding land uses.
d. This request for an extension complies with the Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 13, 1996, the Commission recommended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following:
1. Compliance with all conditions of BaS Resolution Nos. 91-194 and 92-64.
2. This Extension of Time will be in effect until March 9,1997.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, March 17, 1996, and posted on March 15, 1996,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 1, 1996, APPROVED this Extension of Time as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
