RESOLUTION NO. 96-111 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR SUNRISE VISTAS, TRACT 4108, BEING A PORTION OF SECTION 18, TOWNSHIP 19 NORTH, RANGE 21 WEST, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 1, 1996, a public hearing was conducted to determine whether approval should be granted for an Extension of Time, as requested by Robert L. Schuetz, P.E., Mohave Engineering Associates of Kingman, Arizona, for the approved Preliminary Subdivision Plan of Sunrise Vistas, Tract 4108, and WHEREAS, the owners/developers of this tract are Vanderslice 80, Sherman Oaks, California; B&R Development, Fort Mojave, Arizona; and Alexander/Catalina Development, Inc., Azusa, California, and WHEREAS, the subdivision is located south of Bullhead City and east of Highway 95, at the northeast comer of Camp Mohave Road and Vanderslice Road, and WHEREAS, the Preliminary Plan depicts approximately 160 acres subdivided into 705 single- family lots, and a 2.21-acre SD-C (Special Development, General Commercial) parcel. There is a parcel set aside for a sewer treatment plant which has been designated as SD-M (Special Development, Manufacturing). In the event that an agreement is drafted which would move the sewage facility off site, the SD-M designation would revert to SD-C, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on July 23, 1990, per BaS Resolution No. 90-192. The approval of the Preliminary Plan was amended on February 1, 1993, per BaS Resolution No. 93-32. The fIrst Extension of Time was granted on November 2, 1992, per BaS Resolution No. 92-382. BaS Resolution No. 94-134, approved on May 2, 1994, served as the second and third Extensions of Time, making the project current up to July 23, 1994, and allowing one year, expiring on July 23, 1995, to record the tract. Subdivision Regulation Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated", and WHEREAS, the developer has actively pursued the completion of this project. Tract 4108-A was recorded on August 23,1993; Tract 4108-B was recorded on July 1, 1994; and Tract 4108-C was recorded on October 21, 1994, and J ~ . . PAGE 2 OF 2 BK 2710 PG 983 FEE~961787~ RESOLUTION NO. 96-111 Page 2 WHEREAS, the expiration date for a one-year Extension of Time for this development would be July 23, 1996. However, because this date is reasonably close to within 90 days of the anticipated approval by the Board of Supervisors for this request, it is the wish of the applicant to be granted a one-year Extension of Time beyond July 23, 1996, as the recordation of the remaining phases of the subdivision is not anticipated prior to that date, and WHEREAS, the engineer for the project has indicated in a letter dated January 16, 1996, that an Extension of Time is being requested based on the following: "I am requesting an extension of time for the approved Preliminary Plan to July 23, 1997. As of this date the developers have completed the first three phases of the project and will begin construction of the fourth phase in approximately 90 days. A check in the amount of $600.00 is enclosed for the extension fee", and WHEREAS, this will be the fourth and fifth Extensions of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave County General Plan, and the property is designated as an Urban Development Area. c. The site is adequate for the action intended and the proposal is consistent with the surrounding land uses. d. This request for an extension complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 13, 1996, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following: 1. Compliance with all conditions of BaS Resolution Nos. 90-192 and 93-32. 2. This Extension of Time will be in effect until July 23, 1997. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 17, 1996, and posted on March 15, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Mond~x~.'~r!'JI1~#/J 996, APPROVED this Extension of Time as recommended by the Mohave County Planninf~a " '~ission and outlined herein. ..
