A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 51, A RESUBDIVISION
OF TURQUESA ACRES OF SUNWARD HO! RANCHES, IN SECTION 30, TOWNSHIP 23
NORTH, RANGE 16 WEST, FOR A SECONDARY RESIDENCE IN AN A-R/2A
(AGRICULTURAL-RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONE, IN THE
MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on July 22,
1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above described property as requested by Connie James of Kingman, Arizona, and
WHEREAS, this property is located east of Stockton Hill Road, north of the City of Kingman. The
site is accessed from Stockton Hill Road via east on Wilks Ranch Road to Cherum Road, then north on
Cherum Road to Calle Charcas, then east on Calle Charcas to A venida Mendez, then south on A venida
Mendez to Spinner Bait Drive, then east on Spinner Bait Drive to the site, located approximately 1,500 feet
west of North Bank Street. The property has a large single-wide mobile home on it and a small single-wide
mobile home that is not connected to utilities. The terrain is relatively flat, sloping slightly to the west. The
surrounding land uses consist of vacant lots and several residences. There are no significant drainage
patterns crossing the property, and
WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A-R
(Agricultural-Residential) zone for her mother. The Mohave County General Plan designates this area as
a Suburban Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2155B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
May 8, 1996, the Commission recommended DENIAL for a Zonin~ Use Permit based upon the following:
1. This secondary residence on this property is not compatible with the surrounding
neighborhood and would overtax the semi-public water system for the area.
2. The objections of the surrounding property owners.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, July 7,1996, and posted July 5,1996, as required by
Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting
on Monday, July 22, 1996, APPROVED this Zoning Use Permit subject to the following conditions:
I. This Zoning Use Permit is for a secondary residence on this property and the activities
related thereto.
2. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations, Section 27.R (Accessory or Secondary Residence Requirements), and a site
plan in accordance with Section 27,R must be completed and approved prior to approval of
permits.
4, If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5, This Zoning Use Pernlit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety and welfare.
