INDEXED 9630631 BK 27U PG 191 OFFICIAL RECORDS OF MOHAVE COUNTY, f JOAN MC CALL, MOHAVE COUNTY RECORDEI 06/05/96 08:32A PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-198 A RESOLUTION SETTING FORTH A REZONE OF THE NEYa AND THE NY> NWYa OF SECTION 13, EXCEPT FOR THE NORTH AND THE EAST 50 FEET, TOWNSHIP 19 NORTH, RANGE 18 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO M-X (HEAVY MANUFACTURING) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 3, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Lilly V. Lee of Los Angeles, California, being represented by E. R. Bruce of Kingman, Arizona, and WHEREAS, this property is located west of the Griffith Interchange on Interstate 40, south of the City of Kingman. The site is accessed from Interstate 40 via west on Griffith Road to Apache Road and the property. The property is located on the southwest corner of Yucca Drive and Apache Road, The property is vacant and relatively flat, sloping slightly to the southwest. The surrounding land uses consist of vacant rangeland, the proposed Citizens Utilities Company power generation plant to the west, and the Praxair plant to the east. There are no significant drainage patterns that cross the property, and WHEREAS, the applicant requests this zone change to allow for Industrial Development. The applicant proposes to develop approximately 230 acres, The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2500B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b, The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. PAGE 2 OF 2 BK 27~2 PG 192 FEE~9630631 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 8, 1996, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned M-X (Heavy Manufacturing). 2. A Specific Use Permit is required before this property can be developed. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Upon development, Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. In addition, a Limited Drainage Report will have to be submitted to include a method for the on-site mitigation of any additional runoff created by this development. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 5. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 19, 1996, and posted May 17, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 3, 1996, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
