SW'I. OF SECTION 23, TOWNSHIP 21 NORTH, RANGE 18 WEST, FOR AN ABOVEGROUND FUEL TANK IN AN A-R/I0A (AGRICUL TURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 3, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Southern Arizona Paving and Construction, dba Aztec Rock and Asphalt, Inc., being represented by Bruce W. Herman, Manager, of Tucson, Arizona, and WHEREAS, this property is located south of State Highway 68 between Aztec Road and Bacobi Road. The site is accessed from State Highway 68 via south on Aztec Road to Newgard Drive, then east on Newgard Drive to Heber Road. The property is located between Diabase road on the north, Hope Road on the east, Newgard Drive on the south and Heber Road on the west. The property has an asphalt plant on it and the terrain rises sharply to the southeast. The surrounding land uses consist of vacant land. There is a significant drainage pattern that crosses the property from the northeast corner running southwest to the south side of the property, and WHEREAS, the applicant requests this Zoning Use Permit for an aboveground fuel tank. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, this Zoning Use Permit is to correct a violation to the Mohave County Zoning Regulations. WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. f. This is to correct a zoning violation. ~ ... . . PAGE 2 OF 2 BK 2742 PG 186 FEE~9630628 RESOLUTION NO. 96-195 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 8, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is intended for an aboveground fuel tank and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Office of the State Fire Marshal and the local fire department. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. MOHA VE COUNTY BOARD OF SUPERVISORS 4. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 19, 1996, and posted May 17, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 3, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
