HomeMy WebLinkAbout96-189 ~ -.... \DJ \\) . 9630623 BK 27~2 PG 173 OFFICIAL RECOROS OF MOHAVE COUNTY, ( JOAN MC CALL, MOHAVE COUNTY RECORDE' 06/05/96 08:29A PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECOROING FEE 0.00 'M1CROALMW RESOLUTION NO. 96-189 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN OF SHIPP ESTATES III, TRACT 3026, BEING A SUBDIVISION OF PARCELS 13 AND 14, AND THE SY1 OF THE SY1 OF PARCEL 15, AS SHOWN ON RECORD OF SURVEY, BOOK 1, PAGE 35, IN SECTION 12, TOWNSHIP 21 NORTH, RANGE 19 WEST, IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 3, 1996, a public hearing was conducted to determine whether approval should be granted for an Extension of Time as requested by Jesus G. Reyes, General Manager of GV Development, Inc., owner of the property, for the above described Preliminary Subdivision Plan. The engineer ofrecord for the project is Mohave Engineering Associates Inc., Kingman, Arizona, and WHEREAS, the subdivision is located approximately nine miles west of the City of Kingman and is accessed via Highway 68, then south along and west of Teddy Roosevelt Road, and WHEREAS, the Preliminary Plan depicts 90 acres subdivided into 280 single-family lots, and WHEREAS, the General Manager for the project has indicated in a letter dated March 25, 1996, that an Extension of Time is being requested based on the following: "The main reason for this request is the economic condition at the moment. We are still pursuing Phase B and C of Shipp Estates III, Tract 3026, and we have full intention of continuing with the project", and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on May 7,1990, per BOS Resolution No. 90-119. An Extension of Time was requested and fees were submitted on July 21,1992, but due to an oversight the extension was never processed. The first and second Extensions of Time were granted on September 7,1993, per BOS Resolution No. 93-255. The third extension was granted on September 6, 1994, per BOS Resolution No. 94-298. The fourth extension was granted on August 7,1995, per BOS Resolution No. 95-322. Subdivision Regulation Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated", and WHEREAS, the first phase of the project, Tract 3026-A, was recorded on October 1, 1991, and - ._~ ..... . . PAGE 2 OF 2 BK 27~2 PG 17~ FEE~9630623 RESOLUTION NO. 96-189 Page 2 WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development will be reviewed, and has recommended that any required changes or modifications will be the responsibility of the developer, and WHEREAS, this will be the fifth Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 3,1996, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ,\\\\llIi\\1II1I1I/1/111111. ,~':~~~VISOh:%~0J "..;.,,$.~ ~1; u A_~~ A T- :""0'% g;S ~~ ~ 7~ ~ _...-:.. ;::::.~ , rn~ : C"";)S "= a. All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave County General Plan, and the property is designated as an Urban Development Area. c. The site is adequate for the action intended and the proposal is consistent with the surrounding land uses. d. This request does not comply with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 8, 1996, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: I. Compliance with all conditions ofBOS Resolution Nos. 90-119, 93-255, 94-298 and 95-322. 2. Unless significant progress is made in the corning year toward the recordation of this project, Planning staff will recommend denial of any additional Extensions of Time for this Preliminary Plan. 3. This Extension of Time will be in effect until April 2, 1997. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 19, 1996, and posted on May 17, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
