A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON PARCEL B, THE WILLOWS
AT CIMARRON LAKE, UNIT ONE, TRACT 4063, IN SECTION 23, TOWNSHIP 18 NORTH,
RANGE 22 WEST, FOR A 200,000 GALLON WATER STORAGE TANK IN A R-l/8M (SINGLE
FAMILY RESIDENTIAL/EIGHT THOUSAND SQUARE FEET MINIMUM LOT SIZE) ZONE,
IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 3,
1996, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above described property as requested by Willow Valley Water Company, Inc., being represented by J. John
Mihlik, President, of Phoenix, Arizona, and
WHEREAS, this property is located east of Highway 95, south of Bullhead City between Hulet
Avenue and King Street. The site is accessed from Highway 95 via east on Cimarron Boulevard to the site,
located on the south side ofCimarron Boulevard approximately 330 feet east of Highway 95. The property
is a well site with a 200,000 gallon tank in the early stage of construction, It is in violation of the Mohave
County Zoning Regulations for starting construction without a Zoning Use Permit. The surrounding land
uses consist of vacant land to the south and north, and single family residences to the east. To the west
across Highway 95 is Fort Mojave Indian Reservation land. There are no significant drainage patterns
crossing the property, and
WHEREAS, the applicant requests this Zoning Use Permit to allow the placement of a 200,000
gallon water storage tank on the well site parcel. The Mohave County General Plan designates this area as
an Urban Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2605C indicates the parcel described to be
in Zone B, not in the FEMA Special Flood Hazard Area, and
WHEREAS, this Zoning Use Permit is to correct a violation to the Mohave County Zoning
Regulations, and
WHEREAS, the following described Findings of Pact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b, The proposed action and effect complies with the Mohave County General Plan.

c. The site is adequate for the action intended.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
f. This is to correct a zoning violation.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
May 8, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following:
1. This Zoning Use Permit is intended for the placement of a 200,000 gallon water storage tank
on the well site parcel and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits.
COUNTY BOARD OF SUPERVISORS
3. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to construction.
4. The applicant shall paint the tank a neutral earthtone color.
5. If the use has been discontinued for six months after Board approval of the Zoning Use
Permit, then approval shall terminate at that date.
6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety and welfare.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, May 19, 1996, and posted May 17, 1996, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, June 3, 1996, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
