RESOLUTION NO. 96-292 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 17-10, DIAMOND M RANCHES, UNIT 2, IN SECTION 17, TOWNSHIP 21 NORTH, RANGE 10 WEST, FROM A-R/36A (AGRICUL TURAL-RESIDENTIALlfHIRTY -SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/ 15A (AGRICUL TURAL-RESIDENTIAL/FIFTEEN ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, al the regular meeting of the Mohave County Board of Supervisors held on August 5, 1996, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Asa Ward of C.S.N.A. Surveying, representing the owner, Clyde V. Hutchison of Flagstaff, Arizona, and WHEREAS, this property is located east of Kingman and north ofInterstate 40. The site is accessed north approximately one mile on the Fort Rock exit to the site on the south side of the road. The property is vacant. The surrounding land uses consist of vacant land and the terrain is gently sloping. There is a wash beginning at the northeast comer of the property, extending to the southeast portion of the property, and WHEREAS, the applicant requests this zone change to allow the development ofthe property. The applicant proposes to divide the 39.67 acres into two 15-plus-acre parcels. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, the southern parcel is burdened with a utility easement. However, the owner of the property is in the process of purchasing the abandoned airstrip directly west of the southern parcel, and WHEREAS, a review ofFEMA FIRM Panel #040058-2425B indicates the parcel described to be in Zone D, a Special Flood Hazard Area. Mohave County Flood Control District determined a base flood elevation of one-half foot, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site other than the above mentioned Special Flood Hazard Area. RESOLUTION NO. 96-292 Page 2 , . . WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 10, 1996, the Commission recommended DENIAL for a RezQne based on the following: J. Inadequate roadway network. 2. Incompatible with surrounding area. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 20,1996, and posted July 19, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 5,1996, DENIED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein. .
