BK 2852 PG 975 OFFICIAL RECORDS OF MOHAVE COUNTY, I JOAN MC CALL, MOHAVE COUNTY RECORDEf 02/05/97 02'48P PAGE 1 OF 2 MOHAVE COUNTY BOS RECORDING FEE 0.00 DENIED RESOLUTION NO. 96-287 A RESOLUTION SETTING FORTH AN ABANDONMENT OF A PORTION OF ESCALANTE BOULEVARD DIRECTLY ADJACENT TO THE NORTHERLY EDGE OF LOT 135, MEADVIEW HIGHLANDS, TRACT 1195, IN SECTION 1, TOWNSHIP 30 NORTH, RANGE 17 WEST, IN THE MEADVIEW PORTION OF THE MOHA VECOUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 3, 1997, a public hearing was conducted to determine whether approval should be given for an abandonment of a portion of the 84-foot dedicated roadway as requested by John and Juanita Grogan of Meadview, Arizona, and WHEREAS, the site is approximately 70 miles north of Kingman. Access to the site is from Pierce Ferry Road via east on Mead Lane/Meadview Boulevard, approximately one mile to Escalante Boulevard then northward on Escalante Boulevard approximately one and one-half miles to the site. The roadway to be abandoned contains the last 195 feet of Escalante Boulevard, fronting the north property line of Lot 135. The roadway is paved and slopes gently uphill for approximately one-quarter mile prior to its terminus, and WHEREAS, this item was first presented to the Planning and Zoning Commission on July 10, 1996, where it was denied by a 6-2 vote. The Board of Supervisors (BOS) continued the item, Resolution No. 96- 287, at their August 5,1996, meeting. On September 3,1996, the BOS referred the item to Planning and Zoning staff for a second review in light of comments received from the National Park Service condoning the abandonment and not wanting another uncontrolled access to the Lake Mead Recreation Area, which would undermine the purpose of a planned entrance station along Pierce Ferry Road in Section 2, and WHEREAS, a review ofFEMA FIRM Panel #040058-1300B indicates the land described to be in Zone C, not a FEMA Special Flood Hazard Area, and WHEREAS, following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The property is designated as a Rural Development Area and Outlying Community. c. The proposed action may be in conflict with the Mohave County General Plan's goal of providing a comprehensive and efficient road network by obstructing the future extension of Escalante Boulevard to Pierce Ferry Road when growth in the area warrants. d. The Abandonment will not deny legal access to other private land holdings. e. There are no significant environmental factors affecting the site. RESOLUTION NO. 96-287 Page 2 . ~ . . PAGE 2 OF 2 BK 2852 PG 976 FEE~9706029 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 8, 1997, the Commission recommended DENIAL for an Abandonment based on the following: 1. The terrain over the future road alignment is conducive to the extension of Escalante Boulevard to Pierce Ferry Road. There may be a future need to allow the extension of Escalante Boulevard to Pierce Ferry Road as this area develops. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 18, 1997 and January 25, 1997, and posted January 17, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 3, 1997, DENIED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
