TNOEXEli" 9643491 BK 2773 PG 302 OFFICIAL RECORDS OF MOHAVE COUNTY, ( JOAN MC CALL, MOHAVE COUNTY RECORDEf 08/07/96 02:3~P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 96-286 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR WALNUT CREEK ESTATES, UNIT III, TRACT 3043, BEING A SUBDIVISION OF A PORTION OF SECTION 7, TOWNSIllP 20 NORTH, RANGE 17 WEST, IN THE MCCONNICO PORTION OF THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 5, 1996, a public hearing was conducted to determine whether approval should be granted for an Extension of Time as requested by G. Kelly Grier of Burton Engineering, Inc., Bullhead City, Arizona, for the above described Preliminary Subdivision Plan. The owner/developer of the project is Dennis Sim for Walnut Creek Development Co., Kingman, Arizona, and WHEREAS, the subdivision is located approximately four miles southwest of the City of Kingman. The property is accessed via Interstate 40, then southwest on Oatman Highway (Old Highway 66), then west along McConnico Road to the site, and WHEREAS, the Preliminary Plan depicts 211 acres subdivided into 160 single-family residential lots, with a minimum lot size of one acre, and WHEREAS, the engineer has indicated that an Extension of Time is being requested in order to complete the processing of the remaining phases of the subdivision, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on July 6,1992, per BOS Resolution No. 92-236. The fIrst Extension of Time for the approved Preliminary Plan was granted on July 5,1994, per BOS Resolution No. 94-211. The second extension was granted on September 5,1995, per BOS Resolution No. 95-370. Subdivision Regulation Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and WHEREAS, the fIrst phase of this project, Tract 3043-A, was recorded on October 6, 1994. Several homes have been constructed within the fIrst phase, and WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development will be reviewed, and has recommended that any required changes or modifIcations will be the responsibility of the developer, and RESOLUTION NO. 96-286 Page 2 _ . ..-..-- .l"" . . WHEREAS, this will be the third Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave County General Plan, and the property is designated as a Suburban Development Area. c. The site is adequate for the action intended and the proposal is consistent with the surrounding land uses. d. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 10, 1996, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: ... 1. Compliance with all conditions ofBOS Resolution Nos. 92-236, 94-211, and 95-370. 2. This Extension of Time will be in effect until July 6, 1997. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 20, 1996, and posted on July 19, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOL YED, that the Board of Supervisors at their regular meeting on Monday, August 5, 1996, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
