A RESOLUTION SETTING FORTH THE RESCISSION OF P&ZC RESOLUTION NOS. 88-149.
88-150. AND BOS RESOLUTION NOS. 91-126. 91-133. 91-287. 92-111. AND 95-41, WHICH
APPROVED THE PRELIMINARY SUBDIVISION PLAN, FINAL PLAT, REZONING, ZONING
USE PERMIT, ROADWAY ABANDONMENT, PETITION OF EXCEPTION, AND AN
EXTENSION OF TIME FOR AZTEC JUNCTION, TRACT 3019, BEING A SUBDIVISION OF A
PORTION OF SECTION 10, TOWNSHIP 21 NORTH, RANGE 18 WEST, IN THE GOLDEN
VALLEY AREA, MOHA VE COUNTY, ARIZONA.

WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 5,
1996, a public hearing was conducted to determine whether the resolutions conditionally approving the
Preliminary Subdivision Plan, Final Plat, rezoning, roadway abandonment, Petition of Exception, and an
Extension of Time for the above described subdivision should be rescinded, and
WHEREAS, the owner/developer of this subdivision is Jim Kuden, General Partner for Aztec
Junction One Limited Partnership of Escondido, California. The engineer of record for this subdivision was
Mohave Engineering Associates, Inc. of Kingman, Arizona. A letter received from the engineering firm on
May 29, 1996, indicates that they are no longer the engineer for the project, and
WHEREAS, the proposed subdivision was located approximately five miles west of the City of
Kingman. The property is accessed via State Highway 68, then south along and west of Aztec Road, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on October 3,1988, per P&ZC Resolution No. 88-149. The property was conditionally rezoned
at the same meeting, per P&ZC Resolution No. 88-150. The first Extension of Time for the approved
Preliminary Plan was granted on March 4, 1991, per BaS Resolution No. 91-78. The conditional
abandonment ofa portion of Avra Road was approved on April 1, 1991, per BaS Resolution No. 91-126.
The Final Plat for the first phase of this development was conditionally approved by the Board of
Supervisors on May 1, 1991, per BaS Resolution No. 91-133. The second Extension of Time for the
Preliminary Plan was granted on October 21, 1991, per BaS Resolution No. 91-286. A Petition of
Exception was approved on October 21,1991, per BaS Resolution No. 91-287. A Zoning Use Permit was
approved on April 6, 1992, per BaS Resolution No. 92-111. This ZUP allowed temporary use of a mobile
home as a sales office, and certain open lot storage on a portion of the subdivision. The third Extension of
Time for the Preliminary Plan was granted on November 2, 1992, per BaS Resolution No. 92-392. The
fourth extension was granted on February 1, 1994, per BaS Resolution No. 93-359. A portion of the
property was again conditionally rezoned on December 5, 1994, per BaS Resolution No. 94-425. A Zoning
Use Permit was approved on December 5,1994, per BaS Resolution No. 94-426. This ZUP allowed a
temporary swap meet on the property rezoned by BaS Resolution No. 94-425. The fifth Extension of Time
of the Preliminary Plan was granted on February 6, 1995, per BaS Resolution No. 95-41, and

WHEREAS, the developer's request for a sixth Extension of Time of the approved Preliminary Plan
was DENIED by the Board of Supervisors on May 20, 1996, per BaS Resolution No. 96-46, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. BaS Resolution Nos. 94-425 and 94-426 will be brought before the Planning and Zoning
Commission separately, at a later date, with the staff recommendation for rescission.
c. This is an administrative file-closing action, in conjunction with the action and intent of BaS
Resolution No. 96-46.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
July 10, 1996, the Commission recommended APPROVAL of the rescission ofP&ZC Resolution Nos. 88-
149 and 88-150, and BaS Resolution Nos. 91-126, 91-133, 91-287, 92-111, and 95-41, and

WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, July 20,1996, and posted on July 19, 1996, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors at their regular meeting
on Monday, August 5, 1996, APPROVED the rescission ofP&ZC Resolution Nos. 88-149 and 88-150, and
BaS Resolution Nos. 91-126, 91-133, 91-287, 92-111, and 95-41 as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
