RESOLUTION NO. 96-278
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN FOR COURTNEY PARK EAST, TRACT 4147, BEING A
SUBDIVISION OF A PORTION OF THE NW'I. OF THE SW'I. OF SECTION 23, TOWNSHIP 19
NORTH, RANGE 22 WEST, IN THE SOUTH MORAVE V ALLEY AREA, MOHA VE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 5,
1996, a public hearing was conducted to determine whether approval should be granted for an Extension of
Time as requested by G. Kelly Grier of Burton Engineering, Inc., Bullhead City, Arizona, for the above
described Preliminary Subdivision Plan. The owner of the project is Dennis Gootrad of Mohave
Development, Inc., Westlake Village, California, and
WHEREAS, the subdivision is located approximately one and one-half miles south of Bullhead
City. The property is accessed via State Highway 95, then east on Aztec Road, then south along and east
of Mesa Villas Drive, and
WHEREAS, the Preliminary Plan depicts 7. I 2 acres subdivided into 34 multi-family residential lots,
ranging in size from 7,000 to 12,025 square feet, and
WHEREAS, the engineer has indicated that an Extension of Time is being requested in order to
complete the processing of the remaining phases of the subdivision, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on July 6, 1992, per BOS Resolution No. 92-232. The first Extension of Time for the approved
Preliminary Plan was granted on September 6, 1994, per BOS Resolution No. 94-294. The second extension
was granted on September 5, 1995, per BOS Resolution No. 95-363. The Final Plat for the first phase of
this development was conditionally approved by the Board of Supervisors on May 3, 1993, per BOS
Resolution No. 93-143. Subdivision Regulation Article 3.10-1 states: "Upon application to the Commission
and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the
Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then
all proceedings relating to the plat shall be terminated.", and
WHEREAS, the Final Plat for Tract 4147-A was recorded on May 20,1993. The first phase of this
project has been improved, and a number of multi-family units have been constructed. The Board of
Supervisors approved the As-Built Improvement Plans and released all remaining assurances for Tract 4147-
A on June 3, 1996, per BOS Resolution No. 96-182. The Final Plat for the second phase of this project,
Tract 4147-B, has been submitted for review, and

WHEREAS, the Board of Supervisors approved the amendment to BOS Resolution No. 92-255 on
December 4, 1995, per BOS Resolution No. 95-476. This amendment to the zoning resolution allowed
certain open space recreation facilities to be constructed with the second phase of the development, and
WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any
additional submittals of this project for processing, the adequacy of the drainage and compatibility of this
proposed subdivision with surrounding development will be reviewed, and has recommended that any
required changes or modifications will be the responsibility of the developer, and
WHEREAS, this will be the third Extension of Time, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action complies with the Mohave County General Plan, and the property is
designated as an Urban Development Area.
c. The site is adequate for the action intended and the proposal is consistent with the
surrounding land uses.
d. This request complies with the Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
July 10, 1996, the Commission recommended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following conditions:
1. Compliance with all conditions ofBOS Resolution Nos. 92-232, 94-294, and 95-363.
2. This Extension of Time will be in effect until July 6, 1997.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, July 20, 1996, and posted on July 19, 1996, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors at their regular meeting
on Monday, August 5,1996, APPROVED this Extension of Time as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
